Abstract

Mnoge evropske države so v zadnjih dveh desetletjih spremenile pristop do reševanja problematike uporabe prepovedanih drog. Ta ne temelji več na prohibiciji in zatiranju ter zapiranju uporabnikov. Nove politike na področju prepovedanih drog temeljijo na zmanjšanju škode zaradi zlorabe drog in zmanjšanju kršitev z dekriminalizacijo uporabe in posesti manjše količine prepovedanih drog. Magistrsko delo obravnava različne načine omejevanja posesti in uporabe manjših količin prepovedanih drog v tridesetih izbranih evropskih državah ter raziskuje njihov kriminološki, zdravstveni ter socialni vpliv. V večini evropskih držav je uporaba in posest prepovedanih drog kaznivo dejanje, z možnostjo zaporne kazni, vendar se v praksi izvaja omiljena obravnava. V 40% izbranih državah pa je tovrstno dejanje dekriminalizirano. To pomeni, da dejanje v zakonu ni zapisano kot kaznivo ali sploh ni omenjeno. Lahko gre za popolno razveljavitev kazenskih sankcij, oziroma zaporne kazni, ali za preusmeritev na prekrške, ki so sankcionirani z globami. V delu smo preučili vplive, ki jih ima dekriminalizacija uporabe in posesti manjših količin prepovedanih drog na odkrivanje kaznivih dejanj s področja prepovedanih drog, uporabo in razširjenost prepovedanih drog med mlajšimi odraslimi in na problematične uporabnike. Primerjali smo podatke Evropskega centra za spremljanje drog in zasvojenosti z drogami med dvema skupinama držav, in sicer med tistimi, kjer sta uporaba in posest manjših količin prepovedanih drog kaznivi dejanji z možnostjo zaporne kazni, in tistimi, kjer sta dejanji dekriminalizirani.

Secondary title: Comparative analysis of the effects of different restriction policies of illicit drugs in European countries
Secondary abstract: In the last two decades, many European countries have changed their approach for dealing with illicit drug use problem. It is no longer based on prohibition and imprisonment. New policies are focused on reduction of harm, caused by consumption of illicit drugs and reduction of offences by decriminalizing the use and possession of small quantities of illicit drugs. The master's thesis studies different restriction policies regarding use and possession of small amounts of illicit drugs in thirty chosen European countries. It is a research about the social, health and criminological effects of these policies. In most European countries use and possession of small quantities of illicit drugs are criminal offences punishable by imprisonment, however most offenders usually receive mild treatment. In 40% of chosen countries this act is decriminalized. This means, that the act is treated as an administrative offence or it is not mentioned anywhere in legislation. It can either be a complete annulment of all criminal sanctions, including imprisonment, or redirection to civil penalties sanctioned with fines. Research was done determining the impact of decriminalization on detection of drug offences, use and prevalence of illicit drugs and also the impact it has on problematic users. We used the data from European monitoring centre for drugs and drug addiction and compared countries where use and possession of small quantities of illicit drugs is criminalized and countries where it is decriminalized.
