Abstract

Hišna preiskava predstavlja poseg v ustavno pravico nedotakljivosti stanovanja. Odvzem prostosti je največji poseg države v pravice posameznika. Pripor iz ponovitvene nevarnosti mora biti skladen z načelom sorazmernosti. Načelo sorazmernosti je namenjeno omejevanju prekomernih posegov države v pravice posameznika. Sestavlja ga test legitimnosti, kjer je treba odgovoriti, ali je cilj, ki ga zasledujemo, ustavno dopusten. Test sorazmernosti je sestavljen iz treh vprašanj. Ali je ukrep primeren za dosego zastavljenega cilja, nujen v tej meri, da ne obstaja milejše sredstvo za dosego cilja ter sorazmeren v ožjem smislu, ki pomeni tehtanje dveh prirejenih pravic. Uporaba testa sorazmernosti je obvezna za sodišča in državne organe, kadar posega na področje pravic posameznikov. Največji problem je prav prezasedenost Zavodov za prestajanje kazni zapora. Prezasedenost Zavodov vodi v poslabšanje bivalnih razmer za pripornike in zapornike. Če država posamezniku vzame prostost, mora tudi zagotoviti, da odvzem prostosti in izvrševanje kazni potekata tako, da je zagotovljeno spoštovanje človekove osebnosti in njegovega dostojanstva.

Secondary abstract: House search is an invasion of constitutional protection for the home. Deprivation of liberty is an intervention of State in the rights of the individual. Detention of the danger of repetition must be justified by the principle of proportionality. The principle of proportionality constitutes a restriction on excessive government intervention in the rights of an individual. It consists of a test of legitimacy, which is necessary to answer if the objective pursues a constitutionally admissible goal. The second part represents a proportionality test that consists of three questions. Is the measure appropriate to achieve the objective, necessary to the extent that there is no lesser mean to achieve the objective and proportionate in the strict sense, which means weighing two modified rights. Use of the proportionality test is mandatory for courts and public authorities when there exists a restriciton of individual rights. The biggest problem is overcrowding in prisons. Overcrowding leads to worsening of living conditions for detainees and prisoners. If the state deprives an individual of his liberty, it must also ensure that the detention and prison conditions respect human rights and dignity of individuals.
