Abstract

Napake v ravnanju človeka so neizogibne, saj je človek bitje, precej daleč od popolnosti. To bi moralo veljati kot načelno izhodišče pri presojanju človeka, tudi zdravnikov. Splošno poznano je dejstvo, da velja medicina za znanost, ki se ponaša s plemenitostjo in je v družbi globoko spoštovana. Takoj za to mislijo pa se v mislih sodobne populacije, ki zahvaljujoč razviti informacijski tehnologiji in dostopnosti informacij praktično vsem, pojavijo dvomi, pa tudi bolj ali manj globoko nezaupanje v zdravstveni sistem in ravnanja ter odločitve zdravnikov. V svojem magistrskem diplomskem delu sem pod drobnogled postavila inkriminacijo malomarnega zdravljenja in opravljanja zdravilske dejavnosti, vsebovano v 179. členu Kazenskega zakonika. Preko predstavitve zdravstvenih napak, kaznivih dejanj v zdravstvu, primerjalnopravne ureditve ter nato podrobnejše analize navedene inkriminacije, sem želela prikazati njeno poslanstvo ter njen položaj v slovenskem kazenskopravnem sistemu, nato pa prišla do svojega končnega cilja, in sicer nakazati morebitno prihodnost inkriminacije malomarnega zdravljenja. Že na tej točki kaže izpostaviti, da je zdravniški poklic edini izmed poklicev, ki je neposredno obravnavan v KZ-1. Nesporno ni moč dopustiti, da bi bili zdravniki povsem neomejeni z inkriminacijami v kazenskem pravu, saj vendarle opravljajo svoj poklic, kljub temu, da se dnevno srečujejo z reševanjem življenj. Obstajati mora nekakšna grožnja s posledico, ki bo sledila, če bo prišlo do kršitve. Pojavlja pa se vprašanje ali je kazensko odgovornost zdravnika nujno potrebno urediti z inkriminacijami v posebnem delu KZ-1 ali zadostujejo in lahko nanje apliciramo splošne inkriminacije kaznivih dejanj zoper človekovo življenje in telo?

Secondary title: Future of incrimination of negligent medical treatment
Secondary abstract: Human errors are inevitable since people are far from being perfect. This principle should be the basis for assessing people, including doctors. It is known that we deem medicine as science, which prides itself on its nobility and is deeply respected throughout our society. That being said, due to rapid development of information technology and a wide range of information available to everyone, people are having doubts and are deeply suspicious of healthcare systems and doctor’s decisions. In my Master's degree I analyze criminalization of medical negligence and healing activities identified by Article 179 of the Criminal Code. Through medical errors and crimes in comparative law regulation and my detailed analysis I wanted to showcase the mission of the above mentioned criminalization and its positions in the Slovenian penal system. My final goal was to indicate possible incrimination of negligence in the future. It is important to note that a medical doctor is the only profession which is directly discussed in the KZ-1. Doctors should not be completely exempt from the criminal law since they are just carrying out their work even if the nature of that work is saving lives on a daily basis. There should be ramifications if violations occur. The question is, is it necessary to dedicate a special part of KZ-1 to criminal liability of doctors? Or is it enough to apply general criminalization of crimes against human life and body?
