Abstract
Digitalni dokazi so vrsta elektronskih dokazov, ki postajajo čedalje bolj pomembno dokazno sredstvo tudi v kazenskih postopkih. Pravosodnim sistemom povzročajo velike težave, saj so lahko relevantno dokazno sredstvo v vseh pravnih postopkih. Ker so prisotni praktično povsod, je pomembno, da se seznanimo z njihovo uporabo in posebnostmi. Velik poudarek moramo nameniti seznanitvi z novimi oblikami digitalnih dokazov, izobraževanju na področju odkrivanja in preiskovanja zlorab ter ureditvi postopkov zavarovanja in preiskav naprav, ki vsebujejo digitalne dokaze. Tukaj je namreč še vedno največ težav, saj je s pomočjo digitalne tehnologije zelo lahko skriti in omejiti dostop do podatkov, ki bi lahko bili upoštevano dokazno gradivo. Ravno tako jih je težko ovrednotiti enako kot klasične dokaze, saj zaradi svojih tehničnih karakteristik zahtevajo drugačen pristop, da so pravno dopustni in imajo dokazno vrednost. Zavarovanje in ohranjanje takšnih dokazov utegne biti zelo zapleteno in lahko vpliva na njihovo verodostojnost ter na potek in pravilnost končne sodbe. Ker so tudi digitalni dokazi predmet proste presoje, je nujno potrebna zadostna mera ozaveščenosti sodišča in ostalih organov na področju informacijsko-komunikacijske tehnologije in upoštevanje temeljnih postopkovnih pravil. Glede na naraščajoče trende digitalizacije, je utemeljeno pričakovati porast kaznivih dejanj, kjer bo na različne načine prisotna informacijska tehnologija. Države bodo tako prisiljene zakonodajo urediti na način, ki bo omogočal čezmejno in geografsko neomejeno zagotavljanje nadzora. Razvoj sodobne tehnologije pa bo na novo postavil potrebo po presoji med različnimi nameni in cilji kazenskega postopka. Potrebno bo natančno razjasniti, kje se konča dopusten postopek pregona in kje se začne čezmerno poseganje v človekove pravice. V diplomskem delu zato proučujem pomen in uporabo digitalnih dokazov v postopkih in ureditev v slovenski zakonodaji. Raziskujem problematiko zlorab digitalnega gradiva, nastajanje novih načinov uporabe elektronskih naprav za izvrševanje kriminalnih aktivnosti in soočenje našega prava s temi zlorabami. Preučujem tudi primere iz sodne prakse, na podlagi katerih se bom seznanil s postopanjem organov pri uporabi digitalnih dokazov na kazenskem in na civilnem področju.

Digital evidence is an electronic evidence, which has becoming a key proof among criminal proceedings. They can be a relevant evidence in many legal proceedings, which is causing difficulties to judicial systems. Since their presentation practically everywhere, it is very important to get acquainted with their usage and specificities. We need to pay great attention to acquaintance with new forms of digital evidence, education in the field of detection and investigation and the regulation of handling, insurance and investigation of devices that contain digital evidence. The major problem is, that they can be easily hidden through digital technologies. Because of their technical characteristics, they require different evaluation than evidence in classic form. Protection and preservation of such evidence may be very complex, and it can therefore have an impact on the credibility of the evidence thus obtained, and on the course and regularity of the final judgment. Since digital evidence is also subject to discretion, it is essential that a sufficient measure of courtesy of the court and other bodies in the field of information and communication technology and compliance with basic procedural rules is necessary. It is also reasonable to expect an increase in criminal offenses, where information technology will be used in different ways. Countries will be forced to regulate their legislation in order to prevent a sufficient control. The development of modern technology will cause balancing between the different purposes and objectives of the criminal procedure. It will be also necessary to determine, where the permitted enforcement effectiveness is ending and the excessive interference with human rights begins. The importance of digital evidence in procedures, their application and regulation in Slovenian legislation is discussed in my diploma. I am researching the problem of the abuse of digital evidence, the emergence of new ways by using electronic devices for criminal activities and the confrontation of our law with these abuses. A part of this work also examining the case-law on the basis of which I will become acquainted with the handling of authorities in the use of digital evidence in criminal and civil proceedings. |
