Abstract
VV diplomski nalogi so najprej predstavljene in opredeljene naloge lovskega in ribiškega čuvaja ter naravovarstvenega nadzornika s poudarkom na pooblastilih, ki so jim dana in zaupana. Podrobneje smo pregledali, opisali, analizirali ter primerjali pooblastila, ki jih pri opravljanju svojih z zakonom opredeljenih nalog uporabljajo čuvajsko-nadzorniške službe pri nas. Prav tako nas zanima, kako so zakonsko urejena pooblastila lovskega čuvaja v nekaterih državah Evropske unije.
Vedno večje poseganje človeka v bogastvo narave in s tem povezane dejavnosti bi lahko ogrozili obstoj in preživetje nekaterih živalskih in rastlinskih organizmov. Nadzor nad spoštovanjem predpisov izvajajo različne inšpekcijske službe, policija, lovski in ribiški čuvaji ter naravovarstveni nadzorniki, ki jim je poleg pravic in dolžnosti zakonodajalec predpisal tudi določena pooblastila.
V diplomski nalogi želimo preučiti zakonodajo in pooblastila ter ugotoviti, ali imajo subjekti na področjih lovskega in ribiškega čuvaja ter naravovarstvenega nadzornika enaka ali podobna pooblastila. Ugotovili smo, da bi bilo treba zaradi nestrokovnega izrazoslovja in poenotenja pooblastil nadzorno-čuvajske službe v zakonodaji ustrezneje »konkretizirati« in spremeniti, jih po možnosti združiti v enotna pooblastila, zagotoviti praktično usposabljanje (ki ga izvaja policija), opraviti strokovno usposabljanje in preizkus znanja za vodenje in odločanje v prekrškovnem postopku ter uvesti enotne uniforme za čuvajsko-nadzorniško službo.
Na osnovi analiziranja obstoječega strokovnega gradiva in spoznanja smo vse tri hipoteze potrdili.

In the introduction of the thesis, we present and define the tasks of the game and fish warden and the environmental supervisor with emphasis on powers they have been given and trusted with. We thoroughly reviewed, described, analysed and compared the powers, used by warden-supervisory services in Slovenia to perform their tasks, defined by the law. We also want to determine the legal regulations of powers of game wardens in some States of the European Union.
Increasing human intrusion into nature’s richness and associated activities could endanger the existence and survival of animal and vegetable organisms. Different inspection services, the police, game and fish wardens and environmental supervisors, who ensure compliance with legal norms, perform supervision over compliance and violations of legal regulations from this field.
In the thesis, we want to study the legislation and powers and find out, if game and fish wardens and environmental supervisor have the same or similar powers. We found that it would be due to non-professional terminology and uniformity of powers of the warden-supervisory services necessary to properly concretise and change them in the legislation, combine them into uniform powers when possible, ensure practical training (by the police), undergo professional training and complete the test for leadership and decision-making in the offense procedure and introduce uniform uniforms for the warden-supervisory service.
Based on the analysis of existing professional material and our findings, we confirmed all three hypotheses. |
