Abstract

Vloga policijskega organa v državi je precej pomembna, saj je njegova naloga in dolžnost vzdrževanje dobrih varnostnih razmer. Zakonodaja zato daje policistom pooblastila, med katerimi so tudi taka, ki predstavljajo veliko poseganje v pravice oseb. Prav zaradi tega je zoper policijo uveljavljen nadzor, ki pa mora biti učinkovit. Obliko nadzora med drugim predstavlja tudi pritožba zoper delo policistov. Postopek pritožbe se je na ozemlju današnje Republike Slovenijo skozi leta spreminjal. Sedaj ga podrobneje urejata zakon in pravilnik. Vsakdo, ki meni, da so mu bile v policijskem postopku z dejanjem policista ali pa z opustitvijo dejanja kršene pravice, lahko vloži pritožbo. Vloženo pritožbo prouči ministrstvo za notranje zadeve, ki nato odloči, ali se bo pritožba reševala v pomiritvenem postopku ali pred senatom. V zakonsko določenih primerih pa lahko ministrstvo odloči, da se pritožba ne bo obravnavala. Namen diplomskega dela je predstaviti policijo kot organizacijo, oblike nadzora nad njo in predvsem pritožbeni postopek zoper delo policistov. Predstavljen in analiziran je tudi primer iz prakse, in sicer primer pritožbe, ki se je leta 2017 obravnavala pred senatom, zoper katero je na koncu podana kritična ocena.

Secondary abstract: The Police has a very important role, since its task and duty is to maintain good safety conditions. In this manner, the legislation gives the Police powers and some of them interfere heavily with human rights. This is why police work is subjected to control, which needs to be effective. One type of such control is a complaint against police officers. The appeal process on the territory of the present Republic of Slovenia has been amended through time. Today it is thoroughly regulated in the Act and Rules. An appeal can be issued by each individual, who thinks that his rights have been violated during the police procedure due to actions or lack of actions of a police officer. The issued appeal is reviewed by the Ministry of internal affairs, which then decides, if the appeal will be solved with a conciliation procedure or before the Senate. In accordance with the law Ministry can decide that the appeal will not be discussed. The purpose of the thesis is to present the Police as an organization, types of control over the Police and particularly the appeal procedure against police officers. Presented and analyzed is also an actual case of an appeal, which has been addressed before the Senate in 2017, over which a critical review is given at the end.
