Abstract

Pomembni vrednoti, tako delodajalcev kot tudi zaposlenih, sta zdravje in varnost vseh zaposlenih. Brez spoštovanja teh vrednot je namreč težko pričakovati uspešno delovanje podjetja. Vsaka nezgoda ima svoj vzrok, ki je sestavljen iz več dejavnikov. Najdemo jih v človeku in v delovni okolici, v splošnem pa razlikujemo dve vrsti vzrokov, in sicer objektivne (materialne) in subjektivne (človeške). Da bi se število nezgod v največji možni meri zmanjšalo, ima delodajalec številne obveznosti za zagotovitev varnega in zdravega dela. Delovnopravno varstvo pravic iz delovnega razmerja je zagotovljeno po delovnem, civilnem in kazenskem pravu. Vse pravice in obveznosti, tako delodajalca kot tudi delavca, so jasno opredeljene v Zakonu o delovnih razmerjih in v Zakonu o varnosti in zdravju pri delu. V magistrskem delu nas je zanimala odgovornost delodajalca za poškodbo in škodo, ki jo je delavec utrpel zaradi poškodbe na samem delovnem mestu ali v povezavi s samim delom. Pri tem ločimo odškodninsko in kazensko odgovornost. Za nastanek odgovornosti morajo biti izpolnjene splošne predpostavke civilnega delikta (protipravno ravnanje, škoda, vzročna zveza in krivda). Sodišče mora v vsakem konkretnem primeru najprej ugotoviti, ali se je delavec poškodoval pri delu ali v zvezi z delom in ali so podani pogoji za subjektivno ali objektivno odgovornost. Posebno področje, s katerim smo se ukvarjali v magistrskem delu, je kazenska odgovornost. Kazenska odgovornost delodajalca zaradi ogrožanja varnosti pri delu je opredeljena v KZ-1, 201. členu. V magistrskem delu smo natančneje analizirali kazenskopravno varstvo pravic delavcev glede na določila kazenske zakonodaje.

Secondary abstract: The health and safety of all employees are important values to both, employers and employees. Without respecting these values, it is difficult to expect the performance of the company. Each accident has a cause, which is composed of several factors. They are found in humans and in a work area, generally distinguish two types of causes, namely the objective (material) and subjective (human) causes. That a number of accidents reduce to a greatest extent possible, an employer has many obligations to ensure safe and healthy work. Labor protection of rights arising from employment is guaranteed by labor, civil and criminal law. All rights and obligations of employer and employee are clearly defined in the Labour Relation Act and in the Act of Safety and Health at Work. Master thesis deals with the responsibility of the employer for the injury and damage caused to the worker due to injuries at work or in connection with work. In doing so, we distinguish between damages and criminal liability. The general assumptions of a general civil delict (unlawful conduct, damage, causation and guilt) must be met in order to create liability. In any concrete case, the court must first determine whether the worker was injured at work or in connection with work and if conditions for subjective or objective liability are specified. The special field with which we dealt with master's thesis is criminal liability. The criminal liability of the employer due to a threat to safety at work is defined in Article 201 of the KZ-1. In the master's work, we analysed more closely the criminal justice protection of workers' rights in accordance with the provisions of criminal law.
