Abstract
Magistrska naloga obravnava ključne pravne vire in regulative, ki urejajo disciplinski postopek v policiji. Med temi viri je prav gotovo najpomembnejši Zakon o javnih uslužbencih iz leta 2005, kateremu se pridružujejo še Zakon o delovnih razmerjih (2013) in ostale uredbe iz tega področja. Poleg tega sta za delo policistov pomembna še Zakon o organiziranosti in delu v policiji (2013) in Zakon o nalogah in pooblastilih policije (2013), ki pa ne urejata samega disciplinskega postopka. Med drugim pa so za področje dela policije in samega disciplinskega postopka ključni tudi mednarodni viri s tega področja, med katerimi prav gotovo izstopata Evropska konvencija o varstvu človekovih pravic in temeljnih svoboščin (1994) ter Evropski kodeks policijske etike (2001). Magistrska naloga v teoretičnem delu analizira ključna poglavja in člene iz teh in drugih pravnih aktov, ki regulirajo izvajanje postopka disciplinskih ukrepov v policiji. Ključne faze v postopku so: ugotovitev kršitev javnega uslužbenca in podaja predloga za uvedbo disciplinskega postopka, vročitev sklepa o uvedbi disciplinskega postopka javnemu uslužbencu, vabljenje javnega uslužbenca in prič na razgovor, disciplinska obravnava in vročitev sklepa o disciplinski odgovornosti. Za razumevanje delovanja disciplinskega postopka pa predstavljamo tudi samo organiziranost policije, kot trinivojske institucije, kjer ima vsak nivo lastne naloge in pristojnosti. Skladno s tem bralec razume delovanje hierarhične ureditve policije in zato tudi (ne)smiselnost izvajanja funkcij in pristojnosti v okviru samega disciplinskega postopka. V empiričnem delu magistrske naloge podajamo predloge za izboljšave obstoječega disciplinskega postopka v policiji, na podlagi detekcije dobrih in slabih praks in določitev sedaj veljavnega postopka.

This master's thesis deals with key legal sources and regulations governing disciplinary procedure in the police. Among these, the Public Employees Act (2005) together with the Employment Relationship Act (2013) are certainly the crucial ones. In addition, the Organization and Work of the Police Act (2013) and the Police Tasks and Powers Act (2013) are also important for the work of police officers, nevertheless they do not govern the disciplinary procedure itself. The field of disciplinary procedure in the police is also closely connected and dependent on international sources from this field i.e. the European Convention on Human Rights and Fundamental Freedoms (1994) and The European Code of Police Ethics, Recommendation (2001). The theoretical part of master's thesis focuses on analysis of key chapters and articles from above mentioned, and also other legal acts, that regulate the implementation of disciplinary procedure in the police. The key stages in this process are; defining the nature of violation of a civil servant and submitting a proposal for initiation of a disciplinary procedure, serving a decision of introduction of a disciplinary procedure to a civil servant, invitation of civil servant and witnesses on an interview, disciplinary hearing and handling the decision of disciplinary decision, etc. In order to understand the functioning of disciplinary procedure itself, we also present the organization of the police, as a three-level institution, where each level has its own tasks and responsibilities. Accordingly, the reader understands the operation of police hierarchical organization, and therefore also the (non)sense of carrying out functions and competences within the disciplinary procedure itself. In the empirical part of the master's thesis, we submit our own proposal for improvement of the existing disciplinary procedure in the police, on the basis of detached good and/or bad practices and determinations of the current procedure. |
