Abstract

Mobing je pojav, ki lahko posameznika spravi v najhujše stanje obupa, saj se nad njim sistematično izvaja psihično nasilje, ki se kaže v različnih pojavnih oblikah. Slovenska zakonodaja mobing ureja na različnih mestih, vsaka od ureditev izhaja iz različne panoge prava. Ker je mobing povezan s številnimi negativnimi posledicami neželenega ravnanja na delovnem mestu ali v zvezi z delom, se sankcije večinoma nanašajo le na osebe v delovnem razmerju. Tako Kazenski zakonik (KZ-1) mobing opredeljuje v poglavju o kaznivih dejanjih zoper delovno razmerje in socialno varnost, kjer kaznivo dejanje šikaniranja opredeljuje kot kaznivo dejanje zoper zaposlenega. Zakon o delovnih razmerjih, ki prav tako nudi pravno varstvo pred mobingom, slednjega nudi le zaposlenim. V nalogi sem raziskovala, ali naša zakonodaja pravno varstvo pred mobingom nudi tistim, ki dela ne opravljajo na podlagi pogodbe o zaposlitvi. Osredotočila sem se le na začasno in občasno delo dijakov in študentov, na t. i. študentsko delo. S pomočjo analize obstoječe literature, analize in interpretacije obstoječe zakonske ureditve, kvantitativne in kvalitativne raziskave sem iskala rešitve problema nezaščitenosti študentov pred mobingom. S kvantitativno raziskavo sem potrdila svojo hipotezo, da večina študentov mobinga, ki se nad njimi izvaja, ne prijavi. Ugotovila sem, da je zakonodaja napisana pomanjkljivo, ter da bi mobing nad študenti navsezadnje le moral biti v pristojnosti Inšpektorata RS za delo. Študentsko delo so z novo zakonsko ureditvijo še bolj izenačili z delovnim razmerjem, a vendar pomanjkanje pravic in (ne)zaščitenost pred mobingom za študente ostajata enaka.

Secondary title: Protection of students from mobbing at the workplace
Secondary abstract: Mobing is a phenomenon that can bring an individual into the worst state of despair, as he is systematically subjected to psychological violence, manifested by various forms of appearance. The Slovenian legislation regulates mobbing in various places, each derives from a different branch of law. Since mobbing is defined with all the negative connotations of unwanted behavior at workplace or in relation to work, sanctions and compensation provisions in most cases apply only to persons in a contract based relationship. Thus, the Criminal Code defines mobbing in the chapter on criminal offenses against working relationship and social security, where the criminal offense of mobbing is determined under criminal offenses against an employee. The Labor Relations Act, which also offers legal protection against mobbing, only offers it to employees. In the assignment, I investigated whether our legislation offers legal protection against mobbing to those who do not work on the basis of employment. I focused only on the student work. By analyzing the existing literature, analyzing and interpreting the existing legislation, doing a quantitative and qualitative research, I was looking for solutions to the problem of student unprotectedness against mobbing. With my quantitative research, I confirmed my hypothesis that the majority of students subjected to mobbing, do not report it. I have found that the legislation is insufficiently written and that mobbing over students should ultimately be the responsibility of the Labor Inspectorate of the Republic of Slovenia. Student work was even more assimilated to regular contract based work by the new regulation, but the lack of rights and (in) protection against mobbing for students, remains the same.
