Abstract

Diplomsko delo se osredotoča na dva od najbolj obremenjenih mednarodnih sodnih organov - Sodišče EU in Evropsko sodišče za človekove pravice in razmerje med njima. Čeprav sta oba del različnih pravnih sistemov, se v delu varovanja človekovih pravic njune pristojnosti prekrivajo. Evropsko sodišče za človekove pravice je bilo v okviru Sveta Evrope ustanovljeno prav z namenom varstva človekovih pravic in temeljnih svoboščin, medtem ko je bila Evropska unija najprej zgolj ekonomska skupnost, v kateri se je šele kasneje pojavila potreba po varovanju človekovih pravic. Glavna pomanjkljivost trenutne ureditve je nekakšna dvojna ureditev, saj so iste človekove pravice različno urejene v različnih pravnih dokumentih in jih posledično nadzorujejo različni organi - v tem primeru celo iz različnih organizacij. Ravno iz tega razloga se že več desetletij pojavljajo težnje, da bi Evropska unija pristopila h Konvenciji o človekovih pravicah. Leta 2014 je Sodišče EU z Mnenjem 2/13 zavrnilo težko pričakovan osnutek za pristop EU k EKČP, ki so ga pripravili predstavniki obeh organizacij. Odločitve Sodišča EU mnogi niso pričakovali in začela so se pojavljati vprašanja, kolikšen je še interes Evropske unije, da pristopi k EKČP.

Secondary abstract: The thesis focuses on two international judicial authorities - the Court of Justice of the European Union and the European Court of Human Rights - and the relation between the two. Although they come from different legal systems their jurisdiction regarding the protection of human rights overlaps. The European Court of Human Rights was founded on the initiative of the Council of Europe with the main purpose being to protect human rights and fundamental freedoms. The European Union, on the other hand, was primarily founded solely as an economic community, with the need of protection of the human rights emerging later. Main disadvantage of the current arrangement is that the rights are arranged differently in different legal documents and consequently supervised by different bodies and in this case even organisations. In the last few decades, the tendencies for the EU to accede to the European Convention on Human Rights have become quite strong. With the Opinion 2/13 in 2014 the Court of the European Union rejected the long-awaited draft for the accession of the EU to the European Convention on Human Rights drafted by members of both organisations. The Court's decision was unexpected and the question arose on whether the European Union still wants to go forth with the accession of the European Convention on Human Rights.
