Abstract

Pravica do državljanstva je ena najpomembnejših temeljnih človekovih pravic, lahko bi rekli tudi "pravica imeti pravice", ki je zagotovljena že s Splošno deklaracijo o človekovih pravicah. Kot taka je temelj za ostale politične, socialne, ekonomske in državljanske pravice, ki iz nje izhajajo. Države pa se lahko same suvereno odločijo komu in pod katerimi pogoji jo bodo podelile. Večina držav tako podeljuje državljanstvo bodisi po načelu "ius sanguinis" (pridobitev državljanstva po rodu) ali "ius soli" (pridobitev državljanstva po kraju rojstva). V diplomskem delu sem primerjala obe ureditvi na primeru Slovenije, kot predstavnice načela ius sanguinis in Združenih držav Amerike, kot predstavnice načela ius soli. Z analizo obeh bom poskušala sklepati na prednosti in slabosti ureditve pridobitve državljanstva, uveljavljene v obeh državah.

Secondary abstract: The right to citizenship is one of the most important basic human rights, one could also say the "right to have rights", which is already guaranteed by the Universal Declaration of Human Rights. As such, it is the basis for the other political, social, economic and civil rights that follow from it. Countries, however, can decide for themselves to whom and under what conditions they will grant it. Most countries thus grant citizenship either on the principle of "ius sanguinis" (acquisition of nationality by birth) or "ius soli" (acquisition of nationality by place of birth). In this diploma thesis, I compared the two arrangements in the case of Slovenia, as a representative of the jus sanguinis principle and the United States of America, as a representative of the jus soli principle. Through the analysis of both, I will try to deduce the advantages and disadvantages of the citizenship established in both countries.
