Abstract
Pojav in razvoj interneta v zadnjem desetletju prejšnjega stoletja je povzročil številne spremembe načinov širjenja in sprejemanja informacij, zaradi česar je v današnjem času potrebno ponovno opredeliti številne pravne kategorije. Osrednjo temo magistrske naloge predstavlja področje osebnostnih pravic uporabnikov spletnih omrežjih, kršitve teh pravic in njihovo varstvo. Na eni strani imamo spletna omrežja, ki so v današnjem času najpopularnejša platforma za deljenje misli, idej, dejavnosti, interesov in nenazadnje veliko osebnih podatkov. Na drugi strani imamo osebnostne pravice kot temeljne človekove pravice, ki morajo biti prav zaradi te lastnosti varovane na vseh področjih človekovega življenja. Kaj pa se zgodi, ko se osebnostne pravice in spletna omrežja srečajo? Ljudje spletna omrežja vsakodnevno uporabljamo, vendar se nas večina niti ne zaveda, da so pri tem naše osebnostne pravice zlahka ogrožene. To področje je obravnavano v magistrski nalogi, kjer so uvodoma predstavljene osebnostne pravice kot take in njihovo varstvo. V nadaljevanju pa magistrsko delo predstavlja internet oziroma spletna omrežja ter kršitve osebnostnih pravic na spletnih omrežjih, ki nemalokrat izgubijo v boju s pravico do svobode izražanja. Kršitve osebnostnih pravic na internetu so zelo pogoste, vseeno pa lahko za časa življenja tudi uspešno postopamo proti njim z različnimi instrumenti. Redko kdo pa se vpraša kaj se bo zgodilo z osebnostnimi pravicami po njegovi smrti. Podatki na internetu ostanejo tam tudi po smrti posameznika in se po njegovi smrti ne izbrišejo, zato magistrsko delo na koncu vsebuje še poglavje, ki je namenjeno posmrtnemu varstvu osebnostnih pravic na spletnih omrežjih.

The occurrence and development of internet in the last decade has caused several changes in spreading and receiving information, resulting in the need to re-define several categories of law. Main topic of this Master's thesis is focused on the field of personal rights, which internet users are entitled to, as well as violation and protection of those rights. On the one hand we have web networks, which nowadays are by far the most popular platform for sharing ones thoughts, ideas, activities, interests and at the end of the day a lot of personal information. On the other hand, such an extensive use of those networks and sites require a lot of regulation, to ensure, that the need for privacy and rights of the users are fulfilled. That demanded and led to extensive and detailed expansion and update of the field of law which I'm about to present in this thesis. What happens when personal rights and internet cross paths? Although we use internet on a daily basis, most of us don't even realize, that our rights could be easily compromised or even violated. As an introduction to the topic, I've presented personal rights as such and protection of those rights. Continuation leads to a more thorough presentation of the internet networks, personal rights on those networks and lastly the violation of those rights, which often collide and fall victim to another human right – freedom of speech. Violation of personal rights on the internet is a very common occurrence, but thankfully, we have many effective instruments to sanction them and compensate the affected, while the victims are still alive. But what happens when a person dies, and their information and data still exist on the internet? In my opinion that concern is not expressed often enough, therefore I dedicated the ending chapter of my thesis to posthumous protection of personal rights on the web networks. |
