Abstract

Nove tehnologije prinašajo nove izzive tudi v pravni sistem. Umetna inteligenca je sodobna tehnologija, ki spreminja delovanje različnih družbenih panog. Pojavlja se vprašanje, ali lahko umetna inteligenca popolnoma in samostojno nadomesti sodnika, ali pa mu lahko le pomaga pri odločitvah. Vpeljava umetne inteligence v procese kazenskega postopka lahko predstavlja tako prednost kot slabost za posameznika glede na obstoječe pravice. Vplive je potrebno podrobno analizirati, spremljati in ustrezno ukrepati - preprečiti je potrebno morebitne negativne posledice. V Združenih državah Amerike uporabljeni sistemi umetne inteligence niso skladni s smernicami Sveta Evrope. Omenjeni sistemi lahko povzemajo in dodatno okrepijo človeške predsodke ter diskriminacijo posameznika (verska, rasna, spolna usmeritev). Tudi v Evropi se pojavljajo poskusi vpeljave sistemov umetne inteligence, vendar rezultati niso prepričljivi. V prihodnosti bodo takšni algoritmi umetne inteligence vsekakor predstavljali pomoč sodnikom pri sprejemanju odločitev, v nekaterih primerih bodo lahko avtomatizirali manj zahtevne procesne naloge. Odločanje o krivdi posameznika s sistemi umetne inteligence trenutno še ni možno. Bodoči razvoj tovrstnih sistemov pa lahko močno spremeni celotni pravni sistem.

Secondary abstract: New technologies also bring new challenges to the legal system. Artificial intelligence is a modern technology that changes the functioning of different social sectors. The question is whether artificial intelligence can completely and independently replace a judge, or whether it can only help him make decisions. The introduction of artificial intelligence into criminal justice processes can be both an advantage and a disadvantage for an individual over existing rights. Impacts need to be thoroughly analyzed, monitored and action taken - any negative consequences should be avoided. In the United States, artificial intelligence systems used are not in line with Council of Europe guidelines. These systems can summarize and further enhance human prejudice and discrimination against individuals (based on religion, race, sexual orientation). There are also attempts to introduce artificial intelligence systems in Europe, but the results are not convincing. In the future, such artificial intelligence algorithms will certainly help judges make decisions, in some cases being able to automate less demanding process tasks. Deciding if an individual is guilty with artificial intelligence systems is not possible yet. The future development of such systems can, however, greatly alter the overall legal system.
