Abstract

Diplomska naloga obravnava premoženjskopravna razmerja med zakonci in s tem povezane nastale spremembe na podlagi uveljavitve Družinskega zakonika. Institut pogodbe o ureditvi premoženjskopravnih razmerij, s katero zakonca vzpostavita lasten pogodbeni premoženjski režim za urejanje medsebojnih premoženjskih razmerij skladno z lastnimi potrebami in željami, zagotovo predstavlja pomembno spremembo na področju družinskega prava. Avtonomno določanje takšnih premoženjskopravnih razmerij bo nedvomno zanimalo prav zakonce, ki se ukvarjajo s podjetništvom. Iz tega razloga je v diplomski nalogi tudi obravnavana tematika opravljanja podjetniške dejavnosti zakoncev ter določitev deleža dolžnika na skupnem premoženju zakoncev. Pri obeh sklopih sta obravnavani hipotezi, postavljeni v začetni fazi priprave naloge. Pri pripravi zaključnega dela smo v največji meri uporabljali deskriptivno metodo, in sicer zaradi vsebinske obravnave in izhajanja iz zakonodajnih aktov, strokovne literature in sodne prakse. Za predstavo prednosti, ki jih je prispevala nova družinska zakonodaja v primerjavi s prejšnjo, smo uporabili komparativno metodo. Namen naloge je prek obravnave premoženjskih razmerij med zakonci v okviru nove zakonodaje prikazati odpravo določenih anomalij in pravnih praznin prejšnjega zakona, konkretneje pa je namen predstaviti pogodbeni premoženjski režim, in sicer kot pomembno spremembo, vezano na urejanje premoženjskopravnih razmerij zakoncev, in predstaviti bistvene problematike, vezane na podjetniško premoženje zakoncev, ter poplačila obveznosti zakonca kot dolžnika.

Secondary abstract: Title of the thesis is property relations between spouses and division of joint property. The thesis discusses the rights in property, arising out of matrimonial relationship, and related changes that have been introduced as a result of the implementation of the Family Code. The introduction of the contract on the regulation of property relations which enables spouses to establish their own matrimonial property regime based on their preferences has been an important addition in the field of family law. Decision-making autonomy in relation to their matrimonial property regime will be of great interest in particularly to spouses who are engaged in entrepreneurial activities. The thesis therefore also discusses the topics of spousal entrepreneurial activity and debtor ratio determination in joint property of spouses. Both topics include hypotheses which were formed in the first stages of the thesis preparation. A descriptive method has mostly been used to approach the topics in the thesis by analysing legislative acts, professional literature and case law, while a comparative method has been used to present the advantages of the new family law by comparing the law in force to its earlier version. The aim of the thesis is to show how some anomalies and legal gaps in the earlier version of the family law have been solved by analyzing the property relations between spouses in the context of new legislation. More specifically, the aim is to discuss the concept of matrimonial property regime as an important change of the property relations arrangement between spouses and to present key challenges related to joint property of spouses stemming from their entrepreneurial activity and the repayment of spousal obligations.
