Abstract
V diplomskem delu sta obravnavani temi javnega naročanja in pravnega varstva v postopkih javnega naročanja. Predstavljeni so osnovni pojmi, temeljna načela, vrste in faze postopkov, odločitve naročnikov ter pravno varstvo, ki je zagotovljeno v teh postopkih. Tema je predstavljena s pomočjo opisne metode. V delu so preverjene tri hipoteze, pri čemer sta po analizi podatkov dve potrjeni, ena pa le delno potrjena. V celoti potrjeni sta hipotezi, da pravni sistem Republike Slovenije ne zagotavlja zadostnega pravnega varstva v postopkih javnega naročanja in da naročniki nimajo dovolj strokovnega znanja za pripravo kakovostnih javnih naročil, zaradi pomanjkljivo pripravljene dokumentacije pa je posledično več možnosti za kršitve. Hipotezo o nezadostnem pravnem varstvu sem potrdila na podlagi ugotovitve, da zoper odločitev Državne revizijske komisije ni konkretnega pravnega varstva. Pri potrjevanju hipoteze o nezadostnem strokovnem znanju naročnikov je strokovnost razdeljena na poznavanje prava javnega naročanja in poznavanje predmeta javnega naročila. Skozi posamezne faze postopka je predstavljeno, kaj pravo javnega naročanja zahteva od naročnikov in kateri problemi se največkrat pojavljajo. Razloge za potrditev hipoteze o nezagotavljanju konkurence sem navajala v povezavi s kompleksnostjo in zahtevnostjo sistema javnega naročanja v Republiki Sloveniji. Ta hipoteza je bila delno potrjena, saj bi za popolno potrditev potrebovala analizo konkretnih primerov, ki dokazujejo nezmožnost priprave konkurenčne ponudbe. Obravnavana problematika je pomembna, saj področje javnega naročanja zajema velik del subjektov, ki v njem sodelujejo, tako javnega kot zasebnega prava. Zaradi širine področja in števila sodelujočih subjektov je posledično obsežna tudi problematika, ki se pojavlja.

Secondary abstract: |
In this degree paper is discussed about public procurement and the legal protection in the procurement procedures. There are described the basic concepts, fundamental principles, types and phases of procedures, desicions of public procurers and legal protection in these procedures. The topic is presented using a descriptive method. Three hypotheses are tested in the paper, two of which are confirmed after data analysis and one is only partially confirmed. First confirmed hypothesis says that the law system in the Republic of Slovenia does not provide sufficient legal protection in public procurement procedures. The second hypothesis, which is also entirely confirmed, says that public procurers do not have enough specialized knowledge to prepare quality public procurement contracts, which, as a result of insufficiently prepared documentation, leads to more potential for violations. I confirmed the hypothesis of insufficient legal protection on the basis that there was no concrete legal protection against the decision of the State Audit Commission. In confirming the hypothesis of insufficient expertise of the contracting authorities, the expertise is divided into knowledge of the law of public procurement and knowledge of the subject of the contract. Through each stage of the procedure, it is presented what the procurement law requires from the contracting authorities and what problems occur most frequently. Third hypothesis says that the law system of the Republic of Slovenia does not always guarantee the possibility to prepare a competitive offer, which consequently does not respect the fundamental principle of ensuring competition between tenders. I stated the reasons for confirming the third hypothesis of nonassurance of competition in connection with the complexity of the public procurement system in the Republic of Slovenia. This hypothesis was partially confirmed, since full confirmation would require the analysis of specific cases demonstrating the inability to prepare a competitive offer. The issue under consideration is important, as the field of public procurement covers a large proportion of the entities involved in it, both public and private law. Due to the breadth of the field and the number of participating entities, the resulting issues are also extensive. |
