Abstract

V diplomskem delu smo predstavili Mednarodno kazensko sodišče (ICC), Mednarodno kazensko sodišče za območje bivše Jugoslavije (ICTY) in t. i. rezidualni mehanizem, ki je slednjega po prenehanju mandata nadomestil. Začeli smo s splošno predstavitvijo mednarodnega kazenskega prava in njegovega razvoja, ki je vodil najprej do ustanovitve Mednarodnega kazenskega sodišča za območje bivše Jugoslavije, kasneje pa do ustanovitve Mednarodnega kazenskega sodišča. Sodišči smo v nadaljevanju opisali in njuno delovanje v praksi ponazorili z analizo dveh sodb, in sicer sodbe v zadevi Bemba za Mednarodno kazensko sodišče in sodbe v zadevi Karadžić za Mednarodno kazensko sodišče za območje nekdanje Jugoslavije. Nadaljevali smo z opisom rezidualnega mehanizma in s ponazoritvijo delovanja z analizo sodbe v pritožbenem postopku v zadevi Karadžić, in nato ugotavljali ali je rezidualni mehanizem učinkovito nadomestil Mednarodno kazensko sodišče za območje nekdanje Jugoslavije. Diplomsko delo smo zaključili s primerjavo analiz obeh sodb in primerjavo Mednarodnega kazenskega sodišča ter rezidualnega mehanizma. V diplomskem delu je torej opisano delovanje treh sodnih institucij, ki delujejo na mednarodni ravni, delovanje v praksi pa je ponazorjeno z analizo sodb. Namen dela je ugotoviti neodvisnost njihovega delovanja in uspešnost nadomestitve specializiranih sodišč z rezidualnim mehanizmom. Potrditev slednjega in ugotovitev, da je primerjanje njihove neodvisnosti nesmiselno sta podani v zadnjih poglavjih diplomskega dela.

Secondary abstract: In the final assignment, we presented the International Criminal Court (ICC), International Criminal Tribunal for the former Yugoslavia (ICTY) and so called residual mechanism, which replaced the latter after its mandate ended. We began with a general description of international criminal law and its development that led to the establishment of first the International Criminal Tribunal for the former Yugoslavia and later the International Criminal Court. After that we described both and illustrated how they work in practice by analyzing their judgements, the Bemba trial judgement for the International Criminal Court and the Karadžić trial judgement for the International Criminal Tribunal for the former Yugoslavia. We continued with a description of the residual mechanism and illustrated how it works in practice by analyzing the Karadžić appeals trial judgement and determined if the residual mechanism effectively replaced the International Criminal Tribunal for the former Yugoslavia. We concluded by comparing analysis' of both trial judgements and a comparison between the International Criminal Court and residual mechanism. The assignment describes the operation of three judicial institutions which work on an international level and illustrates how they work in practice by analyzing trial judgements. The purpose of the assignment is to determine their independence of operation and the residual mechanism's successfulness of replacing the specialised courts. Confirmation of the latter and realizing the nonsense of determining independence are described in the final chapters.
