Abstract

Diplomsko delo predstavlja primerjalno analizo dveh vrst stvarnopravnih zavarovanj terjatev in sicer ročno zastavno pravico in neposestno zastavno pravico (hipoteko) med antičnim rimskim pravom in pravom Republike Slovenije. Ročna zastava je oblika stvarnopravnega zavarovanja, kjer zastavitelj izroči predmet zastave v posest zastavnemu upniku. Tudi hipoteka je vrsta stvarnopravnega zavarovanja, vendar pa pri njej zastavitelj obdrži posest nad predmetom zastave. Sprva so Rimljani uporabljali le ročno zastavo kot način stvarnopravnega zavarovanja terjatev. Ta način je do določene mere pomanjkljiv, saj mora zastavitelj predmet zastave izročiti zastavnemu upniku, torej ga ne more več uporabljati. To lahko na njegovi strani povzroči mnogo težav, še posebej, če zastavljeno stvar uporablja za pridobivanje dohodkov. Podobno pomanjkljivost najdemo tudi pri fiduciarni odsvojitvi. Postopoma so Rimljani iznašli bolj prefinjen način stvarnopravnega zavarovanja, poimenovali pa so ga hipoteka. Pri hipoteki predmet zastave ostane v posesti zastavitelja, zastavitelj pa je dolžan zastavljeni predmet izročiti zastavnemu upniku pod pogojem, če dolga do zapadlosti ne bi poplačal. Z uporabo opisne in primerjalne metode poskušamo izpostaviti bistvene razlike in podobnosti med ročno zastavo in hipoteko tako z zgodovinskega kot tudi modernega vidika.

Secondary abstract: This thesis provides a comparative analysis of the two types of real security called pignus and hypotheca between ancient roman law and law of the Republic of Slovenia. The term pignus descibes a form of real security, where the debtor hands over a thing to the creditor, whereas the term hypotheca is also a form of real security, but in this case, the property meant to secure a debt, stays in the possession of the debtor. At first, the Romans only used pingnus as a way of real security. This manner is somewhat flawed, because the debtor has to give up a pledged thing to the creditor, therefore he can not use it anymore. This can cause numerous problems on the debtor's side, mainly the loss of income, if the pledged thing is used for providing one. Similar flaw can be found in fiducia. When time passed, they developed something more flexible and called it hypotheca, where the pledged thing stays in the possession of the debtor and the debtor only has to give it to the creditor, if the debt is not repaid in time. Through descriptive and comparative research method we want to expose key differences and similarities between pignus and hypotheca from historical and modern perspective.
