Abstract
Magistrsko delo predstavlja ustreznost obstoječe zakonske ureditve za področje platformnega dela ter kako tem delavcem zagotoviti ustrezno stopnjo socialne varnosti. Prek analize sodne prakse in definicij elementov delovnega razmerja so predstavljene ugotovitve, kako se v okviru opravljanja dela prek spletnih platform kažejo elementi delovnega razmerja, skozi predloge na evropski ravni pa so oblikovalcem politik predstavljeni izzivi, kako se lotiti ureditve tega področja, da bi po eni strani izkoristili pozitivne implikacije in istočasno zmanjševali pritisk na delovno silo in trg dela. Pozitivna obveznost države namreč pomeni, da mora imeti izdelan dober politični program, s katerim bo sistemsko zagotovila kar najbolj kakovostno zaščito in uresničevanje socialnosti in solidarnosti v praksi, kar posledično pomeni, da z uvedbo novih tehnologij in novih oblik dela ne smemo ogroziti socialne strukture in učinkovitega sistema socialne varnosti. Brez ustreznih zakonodajnih sprememb lahko namreč pričakujemo razkroj socialne države, kot jo poznamo danes in ki je kot temeljno načelo opredeljena v 2. členu Ustave Republike Slovenije. V zvezi z uvajanjem novih oblik dela in dela prek spletnih platform je nujno potrebno čim prej pričeti tudi s socialnim dialogom na ravni širše družbe, v katerem se bomo morali vprašati, v kakšni družbi želimo živeti in izpostaviti pomen socialne države, saj raziskovalni del magistrskega dela ugotavlja predvsem, da ta tema med ključnimi deležniki, z izjemo predstavnikov delavcev, ni ne prepoznana in ne obravnavana.

Secondary abstract: |
The Master's thesis determines the relevance of the existing regulation for the field of platform work and how to provide these workers an adequate level of social security. Through an analysis of case law and definitions of the employment relationship elements, it was examined how elements of an employment relationship are shown in the context of platform work. Through proposals at the European level, the challenge of how to tackle regulation of this field in order to exploit the positive implications on the one hand, and, at the same time, reduce the pressure on the workforce and the labour market, was presented to the policymakers. The positive obligation of the state means that a good political programme must be established to ensure the highest possible protection and the realisation of sociality and solidarity in practice systematically, which means that the introduction of new technologies and new forms of work should not jeopardise the social structure and effective social security system. Without proper legislative changes, we can expect the dismantling of the welfare state as we know today, which is defined as the basic principle in Article 2 of the Constitution. With regard to the introduction of new forms of work and work through online platforms, it is essential to start a social dialogue as soon as possible, in which we shall have to ask ourselves in what kind of society we wish to live in and highlight the importance of the welfare state, since it was found in the research part of the thesis that this topic is not recognised and not addressed among the key stakeholders, with the exception of workers' representatives. |
