Abstract
Svoboda gibanja je ena izmed temeljnih človekovih pravic. Države članice Evropske unije lahko svobodo gibanja posameznikom omejijo pod zakonsko določenimi pogoji zaradi varovanja javnega reda, javnega zdravja, javne varnosti ter nujnih razlogov v splošnem interesu, pri čemer morajo biti vsi ukrepi izvedeni v skladu z načeli pravne države. Državljanstvo Evropske unije zagotavlja državljanom in njihovim družinskim članom v primerjavi z nedržavljani pomembne prednosti na področju svobode gibanja, bivanja in dela na območju notranjega trga Evropske unije, kjer velja prost pretok blaga, kapitala, dela in storitev, poleg tega pa prinaša tudi določene politične in socialne pravice. Zaradi vse večje globalizacije in pretoka informacij se ljudje množično selijo zaradi možnosti po boljšem življenju, nevarnosti za življenje ali z željo po združitvi družine. S povečanimi tokovi migracij so soočene tudi države Evropske unije, ki se z ekonomskimi migranti iz tretjih držav ukvarjajo v okviru svojih nacionalnih zakonov in postopkov priseljevanja (na tem področju ohranjajo suverenost), s prosilci za mednarodno zaščito pa v okviru norm za zaščito beguncev in azilnih postopkov, ki jih določa tako mednarodno pravo kot tudi pravo Evropske unije in z njim harmonizirana nacionalna zakonodaja. Skupna azilna politika prinaša veliko izzivov in države članice imajo različne poglede glede njenega izvajanja, vse bolj v ospredje pa se postavlja vprašanje varnosti in problem nezakonitih migracij. Analiza aktualnih ekonomskih in humanitarnih migracijskih tokov ter primerjava različnih idej upravljanja z njimi prinašajo kritično ovrednotenje trenutnega stanja omejevanja gibanja in možnega upravljanja z migracijami v Evropski uniji.

Freedom of movement is one of the fundamental human rights. Member States of the European Union may restrict the freedom of movement to individuals under statutory conditions in order to safeguard public order, public health, public security and other matters of urgency in the public interest, all measures being implemented in accordance with the principles of the rule of law. Citizenship of the European Union provides citizens and their family members compared with non-nationals with important advantages in terms of freedom of movement, residence and work in the area of the European Union's internal market, where free movement of goods, capital, labor and services is in place, in addition, it also brings certain political and social rights. Due to increasing levels of globalization and information flow, people are moving on a large scale because of the prospect of a better life, threats or a desire to unite with the family. Increased migration flows are also faced by the countries of the European Union, which deal with economic migrants from third countries in the framework of their national immigration laws and procedures (in this area they maintain sovereignty). On the other hand applicants for international protection are included in the framework for the protection of refugees and asylum procedures laid down by both international law and European Union law and national legislations following in line. A common policy on asylum brings many challenges and the Member States have different views of its implementation, while the issue of security and the problem of illegal migration are moving to the forefront. An analysis of the current economic and humanitarian migration flows and the comparison of different management ideas bring a critical evaluation of the current state of limiting movement and possible management of migration in the European Union. |
