Abstract

Brezplačna pravna pomoč je eden ključnih institutov, s katerim se zagotavlja pravna država in uresničujejo temeljne človekove pravice. Namenjena je tistim posameznikom, ki si zaradi šibkega finančnega stanja in pomanjkanja sredstev ne morejo privoščiti kvalificirane pravne pomoči. Ne gre za luksuz, temveč je v slovenski pravni ureditvi vse od sprejetja ZPP v letu 1999 za določene postopke zahtevana kvalificirana pravna pomoč. Predmetno magistrsko delo je pregled brezplačne pravne pomoči, tako z vidika prosilca kot tudi izvajalca, konkretno pa tistega najbolj pogostega - odvetnika. Pri raziskavi so uporabljene najbolj tipične metode družboslovnega raziskovanja, in sicer deduktivna metoda, metoda deskripcije, komparativna metoda in analitična metoda. Namen dela je ugotoviti, ali so z aktualno ureditvijo brezplačne pravne pomoči spoštovane temeljne ustavne pravice upravičencev in izvajalcev. Preko različnih zastavljenih ciljev, in sicer ugotovitve, katere ustavne pravice se uresničujejo z brezplačno pravno pomočjo, kateri so kriteriji podeljevanja brezplačne pravne pomoči, kdo so izvajalci brezplačne pravne pomoči in kakšen je sistem nagrajevanja, dobimo odgovor na zastavljena raziskovalna vprašanja. Preko primerjav z nekaterimi drugimi evropskimi državami pa dobimo vpogled v možnosti drugačne ureditve instituta. Ključni rezultat raziskave je, da aktualni sistem brezplačne pravne pomoči varuje temeljne človekove pravice prosilcev, katerim je institut namenjen, izvajanje brezplačne pomoči pa za izvajalce pomeni predvsem dolžnost.

Secondary abstract: Legal aid is one of the key institutes for the rule of law and the realization of fundamental human rights. It is for those individuals who cannot afford qualified legal assistance due to their weak financial situation and lack of financial means. It is not a luxury, but since Slovenia adopted the ZPP in 1999, qualified legal assistance has been required for certain procedures. This master's thesis is an overview of legal aid, from the perspective of the applicant as well as the provider, specifically the most common one - a lawyer. The research uses the most typical methods of social science research, namely the deductive method, the descriptive method, the comparative method and the analytical method. The purpose of the work is to determine whether the current legal aid regime respects the fundamental constitutional rights of eligible persons and providers. Through various set goals, namely the determination of which constitutional rights are exercised through legal aid, what are the criteria for granting legal aid, who are the providers of legal aid and what is the system of remuneration, we get an answer to the research questions asked and through comparisons with some other European countries, insights into the possibilities of different arrangements for the institute. The key result of the survey is that the current legal aid system protects the fundamental human rights of the applicants to whom the institute is intended and the provision of legal aid is primarily a duty for providers.
