Abstract
Magistrsko delo raziskuje aktualno pravno in strokovno vprašanje umestitve slovenskega znakovnega jezika v Ustavo Republike Slovenije. Sklicuje se na domače in tuje doktrinarne in pravne vire ter na mednarodne instrumente s področja človekovih pravic in temeljnih svoboščin, pri čemer je v ospredju pravica gluhe skupnosti do uporabe svojega jezika. Pozornost dela je zato posebej usmerjena v razumevanje slovenskega znakovnega jezika, njegove zgodovine in razvoja ter pomena usvajanja jezika že v zgodnjem otroštvu. Raziskava je pokazala, da je pravica gluhih oseb do uporabe svojega jezika v slovenskem pravnem redu sicer zadovoljivo urejena, vendar gluhim uporabe svojega, tj. znakovnega jezika, ne omogoča v celoti. Komunikacija igra pomembno vlogo v človekovem življenju. Ena od najpomembnejših in osnovnih človekovih potreb je prav potreba po sporočanju. Ker je slovenski znakovni jezik slabo raziskan in gluhi nimajo možnosti izobraževanja v svojem jeziku po vsej vzgojno-izobraževalni vertikali, bi bilo treba pravico do tega znakovnega jezika umestiti v Ustavo Republike Slovenije. S tem bi osmislili pravico gluhe skupnosti do uporabe svojega jezika, dvignili oziroma okrepili pomen znakovnega jezika, približali znakovni jezik ne le gluhi skupnosti, temveč tudi slišeči populaciji, ter omogočili gluhim boljšo vključitev v družbo.

The master thesis explores the current legal and professional issue of the placement of the Slovenian sign language in the Constitution of the Republic of Slovenia. It refers to national and foreign literature and legal sources as well as to international instruments in the field of human rights and fundamental freedoms, with the right of deaf persons to use their language at the forefront. The attention is therefore directed to understanding the Slovenian sign language, its history and development, and the importance of language acquisition at early age The research has shown that the right of deaf persons to use their language is satisfactorily regulated in the Slovenian legal system, however it does not fully enable the use of sign language. Communication plays an important role in human life. One of the most important and basic human needs is the need for communication. As the Slovenian sign language is poorly researched and the deaf do not have the opportunity to be educated in their own language throughout the educational vertical, the right to use the Slovenian sign language should be placed in the Constitution of the Republic of Slovenia. This would certainly raise the awareness and importance of the sign language. Moreover, it would bring the sign language closer to deaf and to hearing population and help the deaf to integrate better into the society. |
