Abstract

Zaščita človekovih pravic je ena izmed pomembnejših nalog države Republike Slovenije, evropske skupnosti in širše mednarodne skupnosti. Vsakdo ima pravico do svobodne izbire načina življenja in svobodnega življenja, nihče ne sme biti zaradi tega diskriminiran. Z razvojem družbe je nujno potrebno tudi sprejemanje drugačnosti. Sprejemanje nečesa, kar je sicer dolgo veljalo za nekaj neobičajnega, je korak naprej v družbeni razvitosti. Magistrsko delo obravnava temo normativnega okvira za spremembo spola, predvsem z vidika učinkovitosti zaščite človekovih pravic v postopku spremembe spola in po njem. V prvem delu so predstavljene oblike spolov, ki odstopajo od binarne oblike. Predstavljeno je tudi, kako se spol lahko razvije, in da se lahko zgodi, da ob rojstvu otroka ni moč jasno določiti spola. V osrednjem delu naloge je podrobnejše predstavljen postopek spremembe spola, spolna identiteta, ki ni vedno identična biološkemu spolu. Magistrsko delo v nadaljevanju predstavlja ključne slovenske predpise, ki so povezani s spremembo spola, sledijo ji evropski in mednarodni. Poudarjeni so predvsem posamezni deli predpisov, ki so najpogosteje kršeni na podlagi spolne identitete. V osrednjem delu je poudarek predvsem na pravni podlagi za postopek spremembe spola in spremembe uradnih podatkov, ki lahko posledica spremenjenega spola. Za lažjo predstavo življenjskih izkušenj oseb, ki se odločijo za spremembo spola, je predstavljenih nekaj praktičnih primerov. Na koncu je podana kritična ocena predpisov, ki urejajo področje spremembe spola, in spremembe spolne identitete, z navedbo predlogov izboljšave splošnega normativnega okvirja za spremembo spola.

Secondary abstract: Protecting human rights is one of the most important tasks of the Republic of Slovenia, the European union and wider international community. Everyone has the right to a free life and to freely choose a way of life. Nobody should be discriminated for this reasons. With the development of society it is also necessary to accept the difference. Acceptance of something, that has been long time considered as something unusual, is a step forward in social development. The master's thesis deals with the theme The Normative Framework for Gender Change, in particular from the point of view of the effectiveness of human rights protection in the process of changing the gender and after it. In the first part gender forms are presented, which differ from the binary form. It is also presented, how a gender can develope. It can happen, that at birth of a child it is not possible to clearly identify the gender. In the central part of the work are presented the process of gender change and a sexual identity, which is not always identical to the biological gender. The master thesis further presents the key Slovenian regulations, followed by European and international regulations, which are related to gender change. Particular emphasis is placed on individual parts of the regulations, which are most often violated on the basis of sexual identity. In the central part, the emphasis is mainly on the legal basis for the gender change process and changes of official data, that may result from a changed gender. Some practical(?) examples are presented, to facilitate the perception of the life experiences of the people, who decide to change gender. At the end a critical assessment of the regulations was performed, which are governing the field of gender alteration and the changes of gender identity with a reference of suggestions for improving the general normative framework for gender change.
