Abstract

Ustavnopravni vidiki izvršbe na nepremičnine v Sloveniji in Republiki Južni Afriki. Osrednji predmet proučevanja v magistrskem delu so ustavnopravni vidiki izvršbe na nepremičnine, s posebnim poudarkom na analizi primerjalnopravnih rešitev, sprejetih v Republiki Južni Afriki. V Evropi smo že nekaj časa priča tendenci konstitucionalizacije zasebnega prava, v skladu s katero sta sferi prava človekovih pravic in zasebnega prava vedno bolj povezani. Vplivi konstitucionalizacije se širijo tudi na področje izvršilnega prava, kjer je treba v razmerjih med subjekti izvršilnega postopka upoštevati učinke ustavnih pravic. Izvrševanje sodnih odločb je temeljno merilo delujoče pravne države in spoštovanja ustavnih pravic. Cilj izvršilnega postopka je uresničevanje upnikove pravice do sodnega varstva, pri tem pa je treba zagotoviti tudi ustrezno varstvo pravic ostalih procesnih subjektov. V izvršilnem postopku prihaja do posrednih in neposrednih konfliktov med ustavnimi pravicami upnika in dolžnika. S preučitvijo zgodovinskih, pozitivnopravnih in primerjalnopravnih argumentov smo odgovorili na vprašanje, kako to konfliktno razmerje uravnotežiti. Upoštevajoč dejstvo, da ima večina ustavnih pravic posredne učinke na zasebnopravna razmerja, je po našem mnenju mogoče z ustvarjalno razlago Ustave RS določene ustavne določbe uporabiti v izvršilnem postopku in zagotoviti ustrezno varstvo pravic upnika in dolžnika.

Secondary abstract: The constitutional aspects of execution against immovable property in Slovenia and in the Republic of South Africa. The master's thesis discusses the constitutional aspects of execution against immovable property, with a special emphasis on the analysis of comparative legal solutions adopted in the Republic of South Africa. For some time in Europe, we have witnessed the tendency of constitutionalization of private law, according to which the spheres of human rights law and private law are increasingly connected. The effects of constitutionalization are also spreading into the field of enforcement law, where the effects of constitutional rights need to be considered in relations between entities of the execution procedure. The execution of judgments is a fundamental criterion of a functioning rule of law and respect of the constitutional rights. The aim of the execution procedure is to enforce the creditor's right to judicial protection, while ensuring the adequate protection of other procedural entities' rights. There are indirect and direct conflicts between the creditor's and debtor's constitutional rights in the execution procedure. By examining historical arguments, legal arguments and arguments of comparative law, we answered the question of balancing the conflicting relationship. Considering the fact that most of the constitutional rights have indirect horizontal effects, it is possible in our opinion to apply certain constitutional provisions in the execution procedure through a creative interpretation of the Constitution of the Republic of Slovenia and ensure the adequate protection of the creditor's and debtor's rights.
