Abstract

Prostitucija v zadnjih desetletjih postaja vse pogostejši predmet preučevanja številnih znanstvenih panog, med njimi tudi pravne. Tej temi je namenjeno tudi to delo, v katerem avtor obravnava odnos vsakokratnih oblasti do prostitucije preko analize postavljenih pravnih pravil in dejanskih ukrepov, namenjenim zatiranju, omejevanju in pregonu prostitucije v obravnavanih časovnih obdobjih. Delo je zasnovano kronološko, od prvih visokih kultur do današnjega dne, prostor preučevanja pa je geografsko osredotočen na Evropo, z izjemo prvega poglavja, ki obravnava Mezopotamijo. Zaradi obsežnosti časovnega ter geografskega okvira predmeta preučevanja so v vsakem izbranem obdobju in prostoru predstavljeni le tisti pravni akti in ukrepi, ki so po avtorjevem mnenju, glede na obravnavano tematiko, najbolj zaznamovali dotično obdobje ali imeli daljnosežnejši vpliv na pravno urejanje prostitucije. Ker gre pri prostituciji za družbeni pojav, so v tem delu v posameznih poglavjih predstavljene tudi nekatere zgodovinske družbene okoliščine, ki so v danem obdobju pomembno vplivale na oblikovanje prava v odnosu do prostitucije.

Secondary title: Historic overview of criminal law prosecution of prostitution
Secondary abstract: During the last decades prostitution has become a frequent subject of research of many different fields, including law. This thesis, in which the author addresses a certain authority’s relationship to prostitution, also deals with the topic through analysis of legal rules and actual measures intended for oppression, limitation and prosecution of prostitution in a certain period. The thesis is set chronologically: from the first civilizations to present day. Geographically, its focus is on Europe, with the exception of the first chapter, which addresses Mesopotamia. Due to the vast geographical and time frame of the subject of study, the author introduces only the acts and measures that, according to the author’s opinion, influenced a certain period the most or had the most long-term influence on legal regulation of prostitution. Since prostitution is a social phenomena, certain chapters also introduce some historic social circumstances, that had an important influence on law-making in relationship to prostitution.
