Abstract
Skrbništvo nad mladoletniki po Družinskem zakoniku je institut, preko katerega se zaščiti pravice in koristi otrok, ko starši ne morejo izvajati starševske skrbi v delu zakonitega zastopanja. O imenovanju skrbnika mladoletniku odločajo okrožna sodišča. Zakonito zastopanje mladoletnikov brez spremstva je način zaščite pravic in koristi mladoletnih tujcev, ki nimajo druge odrasle osebe, ki bi jih lahko zastopala oz. branila njihove pravice in koristi. O imenovanju zakonitega zastopnika odločajo centri za socialno delo. Tako skrbniki kot zakoniti zastopniki imajo veliko obveznosti in odgovornosti, ker pa je njihova funkcija prostovoljna in častna, imajo manj pravic in podpore, kljub temu, da je od njihovega dela odvisna zaščita oz. uveljavljanje pravic njihovih mladoletnih varovancev. Glede na to, da starši obeh skupin mladoletnikov ne izvajajo naloge zastopanja, mora država, ki ima dolžnost zaščititi pravice otrok kot ene najranljivejših skupin, največkrat poskrbeti tudi za njihovo namestitev. To lahko prinese nove izzive, saj ni nujno, da v okolju in sistemu obstajajo možnosti, v katerih bi se pravice otrok v zvezi z namestitvijo uresničevale v največjem obsegu. Kar se tiče mladoletnikov brez spremstva, je potrebno upoštevati tudi zakonodajo s področja tujcev, ki na določenih področjih pravice tujcev, tudi mladoletnikov brez spremstva, omejuje. V praksi te omejitve večkrat pomenijo tudi kršitev pravic mladoletnikov brez spremstva, predvsem v smislu omejitve svobode gibanja.

Secondary abstract: |
According to the Family Code, guardianship of minors is an institution through which the rights and benefits of children are protected when the parents cannot carry out their parental guardianship in regards to legal representation. The guardian for the underage child is appointed by a district court. The legal representation of unaccompanied minors is a way to protect the rights and benefits of underage migrants who do not have another adult person who could represent them or defend their rights and benefits. A legal guardian is appointed by a social work center. Guardians and legal representatives have many responsibilities and obligations, but because their function is voluntary and honorable, they have less rights and support, although the protection and exercising the rights of their underage charges depends on their work. Seeing as the parents of both groups of minors do not carry out the task of representation, the state, who carries the obligation to protect the rights of children, as one of the most vulnerable groups, also has to take care of their placement. This can bring forth new challenges, as it is possible that, in the environment and the system, there are no options in which the rights of the children in regards to placement can be realized to the fullest. In regards to unaccompanied minors, it is also necessary to comply with the legislation regarding foreigners, which in some areas, even with unaccompanied minors, limits their rights. In practice, these limits often also mean the violations of the unaccompanied minors rights, especially in regards to freedom of movement. |
