Abstract
Magistrsko delo obravnava premoženjska razmerja med zakoncema ali zunajzakonskima partnerjema, ki so predmet preučevanja družinskega prava. Premoženjski režim zakoncev je celota pravil, ki urejajo premoženjske odnose med zakoncema ali zunajzakonskima partnerjema ter njihova razmerja do tretjih oseb. Ureditev po Družinskem zakoniku glede premoženjskega režima med zakoncema predstavlja eno pomembnejših sprememb, saj ni več prisilne narave ter zakoncema dopušča poleg zakonitega premoženjskega režima tudi možnost sklepanja pogodbe o ureditvi premoženjskopravnih razmerij. Eno osrednjih in najtežje rešljivih vprašanj v praksi, s katero se soočita zakonca ob razvezi zakonske zveze je delitev skupnega premoženja. Posebej ob dejstvu, da zakon ne našteva primeroma, katere posamezne kategorije premoženja sodijo v skupno ali posebno premoženje zakoncev, ampak to nalogo prepušča sodiščem, da v okviru sodne prakse zakonske določbe interpretira in jih na ta način v praksi dopolnjuje. Pred reformo družinskega prava zakonca nista imela možnosti dogovora o tem, v katero premoženjsko maso spada podjetniško premoženje. Družinski zakonik je zapolnil to pravno praznino in zakoncem omogočil svobodno urejanje podjetniškega premoženja. Ena pomembnejših razlik med zakonsko zvezo in zunajzakonsko skupnostjo je neformalni nastanek zunajzakonske skupnosti, saj za svoj nastanek ne potrebuje sklenitvenega akta. Dilema, ki se na tem mestu pojavi, je veljavnost pogodbe o premoženjskopravnih razmerjih, ki jo skleneta zunajzakonska partnerja, saj zakon določa sklenitev zakonske zveze kot (odložni) pogoj za začetek učinkovanja pogodbe ter vpisa pogodbe v register pogodb o premoženjskopravnih razmerjih. V primeru sklepanja pogodb o premoženjskopravnih razmerjih so tako zunajzakonski partnerji, v primerjavi z zakonci, v slabšem položaju, kar nas vodi do kršitve načela enakosti.

This master's thesis deals with matrimonial property relationships, which are the subject of study of the family legislation. Matrimonial property regime is a set of rules governing property relationships between spouses or unmarried partners and their relationship towards third parties. Regulation as per the Family Code regarding matrimonial property regime represents one of the most significant changes in this respect, given its lack of coercive nature as well as giving the option to spouses to, in addition to the matrimonial property regime, contractually agree on the set-up of their property rights relations. The division of the common property between spouses at the time when the relationship is dissolved remains one of the biggest and complex questions from a practical standpoint. Especially given the fact that the law itself does not specifically list down categories of property which belong either to common or individual property of particular spouse. Rather, this is left to the courts, which have to, within the framework of judicial practice, interpret the statutory provisions and amend the latter in practice accordingly. Prior to the family law reform, spouses did not have the option to agree as to which property would be considered as business property. Family Code has since filled certain legal voids and ensured the spouses with a more liberal regulation of business property. One of the most important differences between a marriage and an consensual union is the informal creation of the consensual union, since it does not require a concluding act for its creation. The dilemma arising in this respect is the validity of the contract with respect property rights relations, concluded between unmarried partners, since the law stipulates the conclusion of marital relationship as a (suspensive) condition for the effectiveness of a contract and registration of the latter into the property rights relations contract register. In case a contract regarding property rights relations is concluded, this leads to an unequal position of the unmarried partners in comparison to spouses, which leads to the violation of the principle of equality. |
