Abstract

Namen magistrskega diplomskega dela je raziskati, kako je urejena pravica do tolmačenja v azilnem postopku v kontekstu mednarodnega prava, zlasti kot se navezuje na procesna jamstva v smislu pravice do obveščenosti, izjave, brezplačne pomoči tolmača in uporabe osebi razumljivega jezika. Osredotoča se na pet vidikov, in sicer družbeno moč prava in jezika, mednarodnopravno ureditev azilnega postopka, posebnosti tolmačenja v azilnem postopku, ureditev pravice do tolmačenja v nekaterih ključnih virih mednarodnega prava in prava EU ter pregled relevantne judikature. Problematika je še posebej aktualna v luči novih izzivov množičnih migracij, ko je kakovost tolmačenja postavljena pod preizkušnjo, s tem pa tudi človekove pravice posameznika. Hipoteza naloge je, da je obstoječa mednarodnopravna ureditev pravice do tolmačenja v azilnem postopku precej ohlapna, kar ustvarja nejasnosti, kaj to pomembno procesno jamstvo pravzaprav zajema, posledično pa postavlja prosilca za azil v negotov položaj.

Secondary abstract: The Master’s thesis aims to explore the right to interpretation in the asylum procedure in the context of international law, particularly as it relates to procedural guarantees in terms of the right to information, the right to be heard, the right to the free assistance of an interpreter, and the right to use a language that the person understands. It focuses on five aspects, namely the social power of law and language, the asylum procedure in international law, the specifics of interpreting in asylum procedures, the right to interpretation as defined in certain key sources of international and EU law, and an overview of the relevant caselaw. This issue is especially relevant today in the light of the new challenges brought on by mass migration, putting the quality of interpretation services as well the human rights of the individual to the test. The hypothesis of this thesis is that the existing regulatory framework of international law on the right to interpretation in the asylum procedure is relatively loose, which leads to ambiguities as to what this important procedural guarantee encompasses, thus putting the asylum seeker in an uncertain position.
