Abstract

Vedno več ljudi zapušča svoja prebivališča zaradi vremenskih razmer, nesreč ter spreminjanja okolja, ki je posledica spreminjanja podnebja. Naraščajoče vode, dezertifikacija, vedno več ekstremnih vremenskih dogodkov povzročajo migracije ljudi, ki so trenutne ali trajne. Napovedi so, da lahko do leta 2050 več sto milijonov ljudi postane trajno izseljenih zaradi poplav, suše, orkanov ter povečanja morske gladine. Naraščanje selitev zaradi okoljskih sprememb je v zadnjih desetletjih privedlo do razprav med mednarodnimi organizacijami in znanstveniki glede zaščite in statusa ljudi, ki migrirajo. Oblikovanje jasne opredelitve oseb, ki se razseljujejo zaradi podnebnih sprememb, je ključno izhodišče za mednarodno zaščito. Nastane pravna praznina za to ranljivo skupino ljudi, za katero ni splošne opredelitve, in posledično nesoglasja, koga je potrebno zaščititi ter na kakšen način. Mednarodno pravo ščiti begunce pred preganjanjem. Vrzel v mednarodni zaščiti pa nastane, ko je potrebno ščititi ljudi razseljene zaradi okoljskih dejavnikov. Obstaja soglasje o obstoju pravne vrzeli; obstaja tudi nesoglasje o sporazumih, kako bi se ta pravna vrzel zapolnila. Okoljski analitiki so že obravnavali begunca zaradi podnebnih sprememb in se zavzemali za sistem globalnega upravljanja za njegovo zaščito, vendar do sedaj neuspešno. Pravna vrzel ostaja odprta. Imamo dokaze o spreminjanju podnebja, za katerega je glavni krivec človeški faktor, ki je napravil nepopravljivo škodo na velikih ekosistemih in planetarnem podnebnem sistemu. V magistrskem delu smo ugotavljali urejenost pravnega statusa in pravne zaščite oseb, ki so jih podnebne spremembe razselile iz svojih habitatov ter z raziskovanjem prihajali do dejstev, da je to področje zelo podhranjeno.

Secondary abstract: Because of climate change and natural disasters, more and more people are forced to abandon their homes. Rising waters, desertification, and other extreme weather phenomena cause mass migration, either short-term or permanent. It is estimated that by the year 2050, more than a hundred million people will permanently emigrate due to floods, droughts, hurricanes, and rising sea level. The rise of migrations because of climate change in the past decade has forced a conversation between international organizations and scientists concerning the protection and status of the people who migrate. Determining a clear title for the people who move because of environmental changes is a crucial step for international protection. A legal gap is presented for this vulnerable group of people for which there is no clear-cut definition. As a result, there are disagreements on who should be protected and how. The international law protects migrants from persecution. However, the issue in international protection arises when there are people who need to be protected and who are forced to migrate because of extreme environmental conditions. There is a consensus regarding the looming legal gap. However, there are also disagreements on how to fill this gap. Environmental analysts have already discussed the migration problem and have pushed for a globally managed system for protecting the migrants. However, this plan could not have been integrated to this day. The legal gap is still present. We have evidence of climate change for which the main culprit are humans who have caused irreversible damage on large ecosystems and planetary climate system. Through the master's thesis we were set to find out the regulations regarding the legal status and protection of people who were affected by the climate change and forced out of their habitats. Through the research we came to a conclusion that this field is largely undeveloped.
