Abstract

Magistrsko delo sistematično obravnava montevidejske kriterije za nastanek države, ki morajo biti kumulativno izpolnjeni, da lahko govorimo o nastanku države. Poleg klasičnih montevidejskih kriterijev, osnovanih na načelu učinkovitosti, smo obravnavali tudi dodatne relevantne kriterije. Podrobneje smo proučili dodatni kriterij priznanja, razlike med deklaratorno ter konstitutivno teorijo in učinke kolektivnega (ne)priznanja. Obravnavali smo tudi razmerje med državnostjo in samoodločbo. O tej smo ugotavljali, ali jo uvrščamo med pravice ali načela. Z deduktivno-analitično metodo smo tako ugotovili, da nastanek države spada na področje mednarodnega prava, razen nekaterih izjem v povezavi s tem. Deskriptivna metoda nam je koristila za opis vseh kriterijev v povezavi z nastankom države, uvrščanje samoodločbe ter za opis mednarodnopravnih pogojev za nastanek države. Prav tako smo z opisno metodo proučili načine nastankov držav in entitet s posebnimi statusi. S primerjalno-pravno metodo smo utemeljili, kateri kriteriji za nastanek države so bili uporabljeni na konkretnih primerih. Z zgodovinsko metodo pa smo si kronološko prikazali uporabo kriterijev in drugih institutov na konkretnih primerih, pred drugo svetovno vojno in po njej. Na podlagi uporabljenih metod smo tako nazorno prikazali, da je kljub pravno določenim kriterijem včasih težko določiti, kdaj država dejansko nastane, se nadaljuje ali izumre. Proces nastanka držav tako še vedno ni popolnoma zaključen, kar je zanimivo za prihodnost obstanka države kot subjekta mednarodnega prava.

Secondary abstract: The master's thesis systematically discusses the Montevideo criteria for state creation which must be cumulatively fulfilled in order to speak about state creation. In addition to the classic Montevideo criteria, which are based on the principle of effectiveness, we also considered additional relevant criteria. We took a closer look at the additional criterion of recognition and the differences between the declaratory and the constitutive theory and legal effects of the collective (non)recognition. We also looked at the relationship between statehood and self-determination. We made sure of the latter whether self-determination is within the rights or the principles. With the deductive-analytical method, we thus established that the creation of a state falls within the scope of international law with some exceptions in relation to the modes of creation. The descriptive method was used to describe all the criteria related to the creation of the state, to the classification of self-determination, and to describe the international legal conditions for the emergence of the state. We also used the descriptive method to look at the state and entities with special statuses. On the basis of the comparative-legal method, we showed which criteria for the creation of the state were applied in certain cases. With the historical method, however, we chronologically looked at the use of criteria and other institutes on specific cases before and after World War II. Based on the methods used, we clearly showed that in spite of legally defined criteria, it is sometimes difficult to determine when a country actually emerges, continues or becomes extinct. The process of the state creation is still not fully completed, which is, of course, interesting for the future of the state as an entity of international law.
