Abstract

Bistvo obravnavane teme je iskanje vsebine policijskega načela sorazmernosti, ki bi uporabljena policijska pooblastila optimiziralo do te mere, da bi onemogočalo nesorazmerno uporabo policijskih pooblastil s ciljem zagotavljanja spoštovanja človekovega dostojanstva. Za raziskavo smo uporabili naslednje raziskovalne metode: induktivno-deduktivno metodo, teoretično in zgodovinsko metodo, primerjalno-pravno metodo, aksiomatsko metodo, metodo klasifikacije, metodo neposrednega opazovanja, metodo modeliranja in metodo analize vsebine. Namen raziskave je proučevanje človekovega dostojanstva, (policijskega) načela sorazmernosti in policijskih pooblastil. Posledično smo raziskovali nastanek in vsebino človekovega dostojanstva in ga povezali s pravno varovanimi pravicami, ki opredeljujejo njegovo vsebino in pomen. Prav tako smo proučili namen, zgodovinski razvoj in vsebino splošnega načela sorazmernosti, ki ga pri odločanju uporabljajo tako mednarodna kot domača sodišča. Namen raziskave je bil tudi podrobna analiza slovenskih policijskih pooblastil, da smo spoznali njihovo raznovrstnost in razpršenost v različnih zakonih ter namen njihove uporabe. Cilj raziskovanja je bil ugotoviti spodnjo in zgornjo mejo načela sorazmernosti in kritična presoja sedanjega zapisa policijskega načela sorazmernosti glede na kriterije strogega testa sorazmernosti, ki ima svoj temelj v praksi pruskega Vrhovnega upravnega sodišča. Glavni cilj raziskave je bil zato oblikovanje zapisa sodobnega policijskega načela sorazmernosti, ki bi že vnaprej omogočal presojo sorazmerne uporabe policijskih pooblastil in s tem preprečeval nespoštovanje človekovega dostojanstva. Pri raziskavi smo se omejili zgolj na slovenska policijska pooblastila. Izvirnost disertacije predstavlja raziskava vplivnega območja policijskega načela sorazmernosti in njegova konceptualizacija za vse prihodnje zapise policijskega načela sorazmernosti kot splošnega načela za opravljanje policijskih nalog.

Secondary abstract: The essence of the discussed topic is the search for the content relating to the police principle of proportionality that would help to optimise the police powers to the extent that would prevent their disproportionate use and ensure that human dignity is always respected. The following research methods were used for the research: inductive-deductive method, theoretical and historical method, comparative-legal method, axiomatic method, method of classification, method of direct observation, modelling method and method of content analysis. The purpose of the dissertation is to study the notion of human dignity along with the (police) principle of proportionality and the current police powers. Consequently, we investigated the origin and meaning of human dignity and linked our findings to the legally protected rights defining this term and its meaning. We also studied the purpose, the historical development and the contents of the general principle of proportionality, which is used in judicial decision-making processes in Slovenia as well as abroad. Another objective of the research is to carefully analyse the police powers in Slovenia and study their diversity as well as their inclusion in various laws and the purposes of their use. The aim of our research was to determine the lower and upper limits of the proportionality principle and critically assess the current record of the police principle of proportionality according to the criteria of a strict proportionality test based on the practices of the Prussian Supreme Administrative Court. Therefore, the main goal of the research was to describe the police proportionality principle in a way that would allow for the assessment of the proportionate use of police powers in advance, thereby preventing the disrespect for basic human dignity. The study is limited to Slovenian police powers. The originality of the dissertation lies in its study of the areas in which the police principle of proportionality is applied as well as in the conceptualisation of the notion of police proportionality as a general principle for carrying out police tasks.
