Abstract

Namen magistrskega dela je proučiti, kako zgodovinska in kulturna dediščina vplivata na ustavno ureditev, prav tako smo želeli proučiti, kakšno vlogo pri tem ima svetovna zgodovina. Podrobno smo proučili države po celinah, ki smo jih izbrali glede na geografsko lego. Proučili smo zgodovino držav Azije, Afrike, Evrope in Latinske Amerike in arabske države. Zgodovino posameznih držav na celini smo proučili od najzgodnejših naselitev plemen in ljudstev. Za izbrane države smo proučili preambulo ali dele ustave, ki se nanašajo na zgodovinsko in kulturno dediščino. Ustavne ureditve se med seboj razlikujejo glede na geografsko lego in pripadnost celini, zaradi vpliva svetovne pretekle in polpretekle zgodovine. Države Azije in Afrike imajo v ustavni ureditvi zapisano kratko zgodovino s poudarkom na boju proti kolonialistom in za neodvisnost. Arabske države imajo v ustavni ureditvi zapisano pripadnost islamu kot državni veri. Države Latinske Amerike v ustavni ureditvi poudarjajo boj proti kolonializmu in boj za neodvisnost. Ustavne ureditve latinskoameriških držav poudarjajo svoje staroselske korenine in indijansko identiteto. V ustavah evropskih držav je v preambuli, če jo imajo, zapisana kratka polpretekla zgodovina, ki se nanaša na ustanovitev države po drugi svetovni vojni. Prav tako se sklicujejo tudi na prednike, na katere so izjemno ponosni. Svetovna zgodovina iz časa preseljevanja ljudstev in kasneje kolonializacije kakor tudi prva in druga svetovna vojna imajo velik vpliv na današnje ustavne ureditve držav, ne glede na celino.

Secondary abstract: The purpose of the thesis is to examine how historical and cultural heritage influence the constitutional regulation. Moreover, we wanted to examine which role global the history has in this regard. We studied in detail the countries across the continents, which we selected according to the geographical position. We examined the history of the countries of Asia, Africa, Europe, Latin America and the Arab countries. The history of individual countries on the continent was studied from the earliest settlement of tribes and peoples. For the selected countries, we examined the preamble or parts of the constitution that relate to the historical and cultural heritage. The constitutional regulations vary from one to another according to the geographical position and the continental position, due to the influence of the past and recent world history. The countries of Asia and Africa have a brief history in their constitution, with an emphasis on the struggle against colonialists and for independence. The Arab countries have a constitutionally established association with Islam as the state religion. The countries of Latin America underlined in the constitutional order the struggle against colonialism and the struggle for independence. The constitutional regulations of the Latin American countries highlight their native roots and Indian identity. Regarding the constitutions of European countries, in the preamble, if any, there is a short recent history about the establishment of the country after the World War II. They also refer to their ancestors, who are they extremely proud of. The world history from the time of the migration of people and later colonization, as well as the both world wars, have a major impact on today's constitutional regulation of the countries, regardless of the continent.
