Abstract

Namen prispevka: V prispevku so predstavljene diskrecijske odločitve policista v Sloveniji, ki jih ta pri svojem delu vsakodnevno sprejema. Članek skuša ponazoriti, kako je zakonodaja s področja varnosti cestnega prometa od 1998 dalje urejala diskrecijske odločitve policistov, predvsem pri odkrivanju in preprečevanju voženj pod vplivom alkohola ter njihov vpliv na zagotavljanje varnosti. Orisano je tudi diskrecijsko odločanje, kot ga v nekaterih postopkih uporablja policija v ZDA, ki izhaja iz anglosaškega pravnega sistema. Metode: Z zgodovinsko-primerjalno metodo je prikazano, kako so zakonski akti za urejanje cestnega prometa, sprejeti v različnih časovnih obdobjih, urejali prosti preudarek policistov v Republiki Sloveniji pri izvajanju nalog na področju zagotavljanja varnosti v cestnem prometu. Uporabljena je še primerjalna metoda in komplementacija prikaza podatkov o policijskih ukrepih. Ugotovitve: Diskrecijska pravica, kot jo dopušča Zakon o pravilih cestnega prometa v določbah 24. člena, je ustrezen kompromis med policijskim zagotavljanjem varnosti in prevelikim poseganjem policije v človekove pravice. Ko oseba deluje neskladno z zakonsko normo, lahko policijsko ukrepanje zaradi takega človekovega delovanja sledi črki zakona, ki največkrat predpisuje represivno ravnanje, lahko pa policist za ukrepanje uporabi taktični preudarek. Navedeno pomeni, da se policist diskrecijsko odloča, katero pooblastilo oz. kateri ukrep bo v dani situaciji uporabil. Ali se policist odloči, da bo deloval diskrecijsko, pa je odvisno od več razlogov, obširneje opisanih v članku. Izvirnost/pomembnost prispevka: Za razlago načel delovanja in uporabe diskrecijske pravice članek preučuje diskrecijske odločitve varnostnih organov, katerih delovanje temelji na različnih pravnih sistemih. Prav tako poskuša odgovoriti na vprašanje, ali je diskrecijska pravica, kot jo uporablja policija v Republiki Sloveniji, primerno urejena in ali je sploh potrebna.

Secondary title: The Discretionary Decision Making of Police Officers Performing the Detention of Drivers Driving While Intoxicated
Secondary abstract: Purpose: The article is a presentation of discretionary decision making on the daily basis by police officers while performing their tasks. It is an attempt to illustrate how the road traffic legislation since 1998 has regulated discretionary decision making of police officers, specifically at detecting and preventing DWI. The article describes the institute of discretionary right as well. For the purpose of more clear presentation, the paper also describes discretionary decision-making as used in some procedures by the US police - the police deriving from the Anglo-Saxon legal system. Design/Methods/Approach: By using the historical-comparative method, it is demonstrated how the legal acts regulating road traffic, adopted at different time periods, have influenced Slovenian police officer’s discretionary decision making in the field of road traffic safety. Comparative method and complementation of data on police measures are used as well. Findings: Applying the discretionary right as it is allowed by article 24 of the »Act of rules in road transport« is an appropriate compromise for achieving the highest level of road traffic safety on one hand and breach of the basic human rights by the police on the other hand. When a person breaks the law, police action that follows usually includes repressive measures, prescribed by the law, but the police officer may use a tactical discretion. This means that the police officer discretionary decides which measure will be used in a given situation. Police officer’s decision to use discretionary powers depends on a number of reasons, which are thoroughly described in the article. Originality/Value: For interpretation of the principles and for interpretation of the mode of usage of discretionary decision making, the article describes the discretionary decision making within different legal systems. The article is also addressing the question whether the discretionary right given to the Slovenian police by road traffic legislation is properly regulated and needed at all.
