Abstract

Namen prispevka: V prispevku bomo poleg predstavitve nove pravne ureditve nasprotja interesov, katerega okoliščine predstavljajo pomemben dejavnik tveganja za nastanek korupcije in drugih nepravilnosti v organizacijah, predstavili tudi analizo ugotovljenih primerov nasprotja interesov, s čimer bomo celovito prikazali značilnosti, pojavne oblike ter posledice takšnih okoliščin. Metode: Po preučitvi primarnih virov smo z metodo analize besedil opravili (s pomočjo programa ATLAS.ti 6) kvalitativno in kvantitativno analizo dokumentov Komisije za preprečevanje korupcije o nasprotju interesov. Ugotovitve: Izmed 62 konkretnih okoliščin nasprotja interesov, kjer zasebni interes vpliva na objektivno in nepristransko opravljanje del uradnih oseb, se je največkrat nedovoljeni zasebni interes pokazal na državni ravni pri postopkih javnih naročil in pri poslovanjih med organi in subjekti, ki imajo skupno točko – uradnika. Na lokalni ravni pa se je subjektivno postopanje najbolj izkazalo na področju urejanja okolja in prostora. Pomembna je potrditev, da takšne okoliščine predstavljajo korupcijo, zmanjšujejo zaupanje ljudi v državo in negativno vplivajo na ekonomski sistem države. Kot odziv na izpostavljena korupcijska tveganja je zakonodajalec v letu 2010 in 2011 na novo uredil preventivni in represivni sistem s tem v zvezi. Omejitve in praktična uporabnost raziskave: Raziskava je omejena na Slovenijo, pri čemer je praktična vrednost prispevka v prikazu in oceni nove kriminalitetne politike glede nasprotja interesov ter v identifikaciji elementov, značilnosti in posledic ravnanja posameznikov, ki so bili v nasprotju interesov. Izvirnost/pomembnost prispevka: V Sloveniji še ni bilo opravljene podobne analize, ki bi na konkretnih primerih nasprotja interesov ugotavljala značilnosti, naravo in posledice le-teh.

Secondary abstract: Purpose: The purpose of the work was to explore new legal provisions on conflicts of interest which present an important risk for corruption and other irregularities in institutions as well as presenting the results of the analysis of actual cases of conflicts of interest by showing the complete picture of the characteristics and the consequences of their circumstances. Methods: After examining the primary sources (legal provisions), the study took a qualitative and quantitative approach based textual analysis method of cases of conflict of interest in Slovenia, which were examined and analysed with the Atlas.Ti6. Findings: Among 62 cases of conflict of interest, where private interest influenced the objective and impartial performance of public officials, the most illicit private interest was shown at national level in public procurement procedures and in the business transactions between institutions and persons which have a common purpose - the public official. At local level, the most subjective performance was in procedures regarding the environment. The important findings are that these circumstances constitute corruption, reduce peoples’ confidence in state institutions and affect the economic system of the state. In response to such risks, Slovenia adopted, in 2010 and 2011, new preventative and repressive measures. Research limitations/implications: The study is limited to Slovenia, where the practical value of the contribution is in the demonstration and assessment of new provisions regarding conflict of interest and in the identification of the elements, characteristics and consequences of the behavior of the individuals involved. Practical implications: In Slovenia, there have not yet been similar analyses of legal provisions and of specific cases to identify the features, nature and the consequences of conflict of interest.
