Abstract

Sodelovalna ekonomija prinaša mnogo novih vprašanj, ki s strani primernih zakonodajnih teles še niso bila naslovljena. Novih dilem je veliko, rešitve na pereča vprašanja pa po večini še niso bile izoblikovane. V magistrski nalogi se zamejujem na povezavo med sodelovalno ekonomijo in morebitnim porastom diskriminacije, ki jo le-ta potencialno prinaša. Vzpon sodelovalne ekonomije ne zadeva le ekonomskih in gospodarskih področij, temveč posega tudi na druga področja družbe. Sodelovalne platforme namreč uporablja veliko število ljudi, s čimer neizogibno prihaja do novih vprašanj, ki prej morda niso bila v ospredju. Eno od teh je gotovo porast diskriminacije na sodelovalnih platformah. V prvem večjem sklopu magistrske diplomske naloge tako raziskujem ključna vprašanja, povezana s sodelovalno ekonomijo, in pravno urejanje področja v slovenskem pravu in pravu Evropske Unije. Osrednje vprašanje magistrske diplomske naloge je raziskovanje vprašanja, kakšne prepreke prinaša vzpon sodelovalne ekonomije pravu varstva pred diskriminacijo. Predhodna ugotovitev, ki služi kot ogrodje osrednjemu poglavju, je ugotovitev, da vse sodelovalne platforme nimajo enakih bistvenih lastnosti in jih tako ne moremo enačiti ter obravnavati enako. Skladno s to ugotovitvijo so tudi izzivi, ki jih ustvarja vsaka skupina sodelovalnih platform, drugačni. V zadnjem večjem poglavju naloge pa skušam najti potencialne rešitve za predhodno opisane izzive.

Secondary title: Challenges posed by emergence of sharing economy to anti-discrimination law
Secondary abstract: Emergence of sharing economy introduced many new questions, which have yet to be addressed by legislative bodies. There is a lot of new issues but not yet many solutions. In my thesis, I will be exploring connection between the emergence of the sharing economy and potential rise in discrimination. The rise of sharing economy does not affect only economical and business areas but also other aspects of modern society. Sharing platforms are used by many people and so it is inevitable that new dilemmas arise, that perhaps were not in the forefront before. One of said new questions is the rise of discrimination on the sharing platforms. In the first mayor part of the thesis, I will describe key aspects and questions regarding the sharing economy and also legal regulation of sharing economy in both Slovenian and European Union Law. However, the central part of the thesis is exploring what new challenges the rise of sharing economy conveys to anti-discrimination law. Preliminary finding that serves as a framework for the chapter is that not all sharing platforms have the same basic characteristics and so not all are equal and should not be treated as such. In accordance with said finding, not all challenges posed by sharing platforms are the same. In the last mayor part of the thesis, I try to propose some new solutions for described challenges.
