Abstract
Delo policistov je zelo odgovorno in zahtevno. Vsaka situacija zahteva od policista trezno presojo, pravilno odločitev, upoštevanje navodil in skrb, da bodo vpleteni izpolnili njegova navodila. Z zakonom so določena pravila kako in na kakšen način policist izvaja svoja pooblastila. Z upoštevanjem pravil iz policijskega kodeksa pa policist upošteva etična in moralna načela. Čeprav se policist trudi po najboljših močeh izpolniti svoja navodila in uresničiti pooblastila, še vedno lahko situacije privedejo do tega, da bi vpletene osebe smatrale policistovo delo za nekorektno. V takem primeru je zakonsko določeno, da ima ta oseba možnost pritožbe in več različnih postopkov, kjer se obravnava dotični primer. Sam postopek ne more izbrisati kazni ali policistovega pooblastila, temveč se v tem postopku preverja pravilno ravnanje uradne osebe, torej policista v dani situaciji. V polletnih in letnih poročilih policije so opisani tudi takšni primeri pritožb in njihova rešitev oz. zaključek. Postopek preverjanja pravilne izvedbe policistovih pooblastil je odvisen od tega kakšno in kolikšno silo je uporabil policist v postopku, kakšne so okoliščine, ali je v situacijo vpletenih več oseb ali zgolj ena. Najlažja in najbolj smiselna možnost reševanja pritožb je pomiritveni postopek, kjer se vpletene osebe odzovejo povabilu na postopek in zadevo skušajo rešiti z dogovorom. V kolikor je ne uspejo zaključiti to pomeni, da se zadeva ureja naprej po drugih postopkih. V vsakem primeru predstavljajo javnost in vpleteni civilisti v izvajanje policijskih postopkov nadzor; gre za enega od načinov nadzora policistov, ki je seveda smiseln in tudi potreben, da je izvajanje policijskih pooblastil kar se da korektno.

Review of the regulation of complaints procedures against police work |

Police officers have a very responsible and unique work, because every situation requires police officers to make a sound judgment, right decision and follow the instructions as well as ensuring, that people who are involved in the situation fulfill the given instructions. The law presents the rules for how a police officer performs his or her authority. The police officers must follow the police code, which provides ethical and moral principles. Although the police officer does his best to comply with his instructions and to exercise his authority, situations can still lead to the point that the persons involved consider the police officer's performance inappropriate. In such case, the law offers a possibility that a person can appeal in several different ways. The procedure itself cannot erase the penalty or the police officer's authority. However, the procedure is checked to establish if the police officer took the right decisions and actions. The cases of such situations can be found in semi-annual an annual police reports, which carry the information about how the complaints were closed. The procedure for verifying the correct exercise of a police officer's authority depends on how and to what extent was the force used by the police officer in the procedure, the circumstances and whether several persons or just one were involved in the situation. One of the easiest and most reasonable way of solving such complaints is a conciliation process. The persons involved are invited to come to the procedure and try to resolve the matter by agreement. If that procedure is not successful, the complaint must be solved in other ways. The public and the civilians represent the public control of the police officers. By doing so, they demand, that police work is done appropriately. |
