Abstract

S hitrim razvojem cele vrste tehnologij postajajo brezpilotni letalniki vse bolj tehnično dovršeni, v delovanju vse bolj raznovrstni, zmogljivi in zanesljivi, uporabniku prijaznejši, cenovno dostopnejši in s tem vse bolj razširjeni pripomočki ljudem za opravljanje najrazličnejših dejavnosti. Nekatera človeška ravnanja lahko štejemo za kršitve veljavnih družbenih zapovedi in prepovedi, ki jih z ustavo določeni pristojni zakonodajni in drugi državni organi po posebnih kriterijih izberejo in kot takšne določijo v ustreznih pravnih predpisih. Predmet diplomskega dela je proučitev problema človekovih ravnanj, ki jih štejemo za kršitve veljavnih družbenih zapovedi in prepovedi v povezavi z uporabo brezpilotnih letalnikov v vlogi pripomočkov storitve kaznivih dejanj. V prvem delu raziskujemo razvoj in vrste brezpilotnih letalnikov vključno z rešitavmi obvladovanja virov ogrožanja, ki jih slednji povzročajo ob njihovi nepravilni ali nezakoniti uporabi. Proučujemo, kako je njihova uporaba normativno urejena v Sloveniji in Evropski uniji. V nadaljevanju proučujemo uporabne lastnosti brezpilotnih letalnikov za storitve kaznivih dejanj in nedovoljene posege v človekove pravice ter s pomočjo člankov analiziramo primere nezakonite ali nepravilne uporabe brezpilotnih letalnikov. V razpravi s sintezo analitičnih ugotovitev empiričnega dela naloge združimo ugotovitve za potrditev hipotez. Uporabnost brezpilotnih letalnikov glede na njihove lastnosti proučimo skozi določila normativnih podlag in ob tem identificiramo možnosti storitve kaznivih dejanj oziroma kršitve pravil ter hkrati proučimo normativno pravne varovalke, ki naj bi zlorabe preprečevale. Podatke, ki smo jih pridobili s pomočjo prebiranja domače ter tuje literature, smo dopolnili z izvedbo intervjuja. V zaključnem delu naloge predlagamo nadaljne korake na področju obvladovanja tveganj, ki jih povzročajo brezpilotni letalniki za storitve kaznivih dejanj ali ogrožanje človekovih pravic.

Secondary abstract: With the rapid development of a wide variety of technologies, unmanned aerial vehicles (UAVs) are becoming increasingly technically advanced, versatile, powerful, reliable, user-friendly and affordable, and as such a widespread tool for a variety of activities. Some human actions can be considered as violations of the applicable social norms and prohibitions, which are selected according to special criteria by the competent legislative and other state bodies designated by the Constitution, and are determined as such by the relevant legal regulations. The thesis studies the problem of human actions considered as violations of applicable social norms and prohibitions and related with the use of UAVs as aids in criminal offences. In the first part, we explore the development and types of UAVs, including countermeasure solutions to the threats posed by a possible illegal use or misuse of these vehicles. We examine the normative regulation of their use in Slovenia and the European Union as well as the characteristics of UAVs that come useful in criminal offences and unauthorised human rights violations. With the help of information from the articles, we analyse the cases of illegal use or misuse of UAV's. In the discussion, we synthesize the analytical findings from the empirical part of the thesis and combine the findings to confirm the hypotheses. Furthermore, we examine the usefulness of UAVs according to their characteristics from the perspective of normative provisions and at the same time identify the possibilities of criminal offenses or violations of rules. Simultaneously, we study the normative and legal safeguards designed to prevent the abuse. The data obtained through Slovenian and foreign literature are complemented by an interview. In the conclusion, we propose further steps in the management of risks posed by the use of UAVs in criminal offences or threats to human rights.
