Abstract

Impeachment ali zanj uveljavljen izraz ustavna obtožba je ustavni institut, izvirajoč iz srednjeveške Anglije, ki omogoča postopek obtožbe državnih funkcionarjev ob kršitvi ustave in zakonov ter s tem omogoči odstranitev neprimernega kandidata iz svoje visoke in odgovorne državne funkcije. V diplomski nalogi je za širše razumevanje instituta na začetku opisan pojem pravne države, demokracije in delitve oblasti, iz katerih posredno in nujno povezano izhaja impeachment. V nadaljevanju je opisan zgodovinski pregled izvora instituta, njegova vključitev v svetovne ustave ter njihove primerjave, saj se ustavne ureditve instituta med seboj razlikujejo. Te razlike so najbolj opazne v odgovornih subjektih, pristojnih organih za ugotavljanje odgovornosti, postopku in sankcijah, ki obtožene doletijo. Končno poglavje je osredotočeno na primere predsedniških obtožb, ki dajejo odgovor podani hipotezi. Med raziskovanjem smo uporabili deskriptivno metodo zaradi vsebinskega izhajanja iz izbrane strokovne literature, zgodovinsko in primerjalno metodo pri primerjanju državnih ustavnih ureditev. Želimo prikazati posebnost in tudi pomembnost zasenčenega instituta, ki s svojim obstojem pripomore k ohranjanju ravnovesja oblasti in ohranjanju pravne in demokratične države. S podano hipotezo pa smo želeli predstaviti vidik ranljivosti in lahke zlorabe instituta, saj je ta nemalokrat izrabljen kot orodje političnih strank v želji po oblasti in odstranitvi tekmecev. Z diplomsko nalogo želimo izpostaviti pomembnost tega posebnega in starodavnega instituta in opozoriti na izkoriščanja ob njegovi uporabi ter spodbuditi nadaljnje raziskave, saj je področje instituta posebno v državah poznih demokracij še neraziskano.

Secondary abstract: Impeachmentoriginates from medieval England and allows the prosecution of officials when violation the constitution and laws by removing theunsuitable candidate. For broader understanding of the institute, the notion of the rule of law, democracy and division of power is described from the beginning, from which impeachment derives indirectly and it is necessarily connected. It continues with a historical review and with the adoption into the world constitutions and their comparisons, as the arrangements of the institute differ from each other. These differences are in the responsible entities, the authorities for determining responsibility, the procedure and the sanctions that fall on the accused. The final chapter focuses on examples of presidential accusations that provide an answer to a given hypothesis. During the research, we used a descriptive method due to the content based on selected literature, a historical and comparative method when comparing state constitutional arrangements. We want to show the uniqueness and the importance of the institute, which its existence helps to maintain the balance of power and preserve the rule of law and democracy. With the given hypothesis, we wanted to present the aspect of vulnerability and abuse of the institute, as it is often used as a tool of political parties in desire for power. We want to highlight the importance of this institute and draw attention to the exploitation of its use and encourage further research, as the field of the institute, especially in late established democracies, is still unexplored.
