Abstract
V magistrski nalogi je predstavljen pojem nepisane ustave. Tako pisana kot nepisana ustava služita kot ključni varovalki človekovih pravic. S formalnega vidika je ustava najvišji pravni akt, s katerim morajo biti usklajeni vsi ostali pravni akti (zakoni, podzakonski predpisi in drugi splošni pravni akti). Večina ustav je kodificiranih, lahko pa so tvorjene iz različnih posamičnih aktov, ki so nastali na podlagi običajev in precedensov in bili v pisno obliko pretvorjeni kasneje, znotraj pomembnejših sodnih odločitev, odločb oz. statutov. Nepisane ustave so se pojavile relativno zgodaj, ko so ljudje bodisi ustno bodisi preko preprostih zapisov ohranjali temeljna pravila, ki so predstavljala okvir za lažjo vzpostavitev reda znotraj posamične družbe. Nenapisana ustava plemena Irokezov po mnenju mnogih strokovnjakov predstavlja temeljno osnovo za izgradnjo današnjega močnega konstitucionalnega sistema Združenih držav Amerike. Izhajajoč iz Magne Charte Libertatum so tudi Britanci postavili trdne temelje za eno najobsežnejših nekodificiranih ustav. Prednost gibkih ustav je v njihovi prilagodljivosti, kar botruje dejstvu, da imajo ustavni sistemi močno zgodovinsko zaledje, ki je narekovalo njihovo obliko in sam obstoj. Z razvojem sodne prakse, ki je močno zaznamovala razvoj ostalih, pozneje razvitih ustavnih sistemov, je nepisana ustava predstavljala zibelko mnogim sodobnim demokratičnim institucijam. S precedenčnimi primeri in močnim teoretičnim zaledjem in tolmačenjem pomen pisane ustave marsikje prednjači pred togo pisano ureditvijo, saj zapolnjuje veliko pravnih praznin. V magistrskem delu želimo raziskati, ali nepisana ustava predstavlja poglavitno oviro pri varovanju temeljnih človekovih pravic in svoboščin.

The master's thesis presents the concept of unwritten constitution. Both written and unwritten constitutions function as key guardians of human rights. From a formal aspect, constitution is the highest legal act that all other legal acts must comply with. Most constitutions are codified, but they can also consist of various individual acts that were created on the basis of tradition and precedents and were later converted into written form within major court provisions, decisions or statutes. Unwritten constitutions emerged relatively early when people, whether verbally or through simple records, maintained basic rules that presented as a framework for facilitating order within an individual society. According to many experts, unwritten constitution of the Iroquois tribe is the fundamental basis for creation of today%s powerful United States constitutional system. Originating from Magna Charta Libertatum, the British also laid solid foundations for one of the most comprehensive uncodified constitutions. Advantage of flexible constitutions is their adaptability, confirming the fact that constitutional systems have strong historical background that dictated their form and very existence. With the development of judicature, which strongly influenced evolution of other later developed constitutional systems, unwritten constitution presented the cradle of many modern democratic institutions. With precedent and strong theoretical background and interpretation, the importance of written constitution is in many places ahead of rigid written regulation, since it fills many legal vacuums. In the master%s thesis we want to explore whether unwritten constitution is posing a major obstacle in protection of fundamental human rights and freedoms. |
