Abstract

Namen magistrskega dela je opisati razlike med slovensko in hrvaško zakonodajo v primeru prostorskega načrtovanja,ki je ozko povezano z razlastitvijo, določiti najpogostejše napake pri določanju odškodnin in pokazati na pomanjkljivosti ocenjevanja vrednosti v razlastitvenih postopkih, ker v Sloveniji ne obstaja enotna metodologija, ki bi urejala določanje odškodnin za primere razlastitve. Ker je razlastitev zelo občutljiva zadeva, je treba vztrajati pri tem, da so zadovoljne vse stranke v postopku. Naredili smo analizo cenitvenega poročila in podali par primerov določanja odškodnin v praksi, iz katerih je bilo razvidno, da se bo v prihodnosti moralo nekaj spremeniti glede zakonodaje in samega sistema ocenjevanja vrednosti v primeru razlastitve. Ugotovili smo, da je skozi zgodovino razlastitve prišlo do številnih napak v oceni odškodnin za razlaščeno nepremično, in predlagali, da se na podlagi izkušenj strokovnjakov naredi izboljšava veljavnih zakonov in metodologije ocenjevanja vrednosti nepremičnin v primeru razlastitve.

Secondary title: The process of expropriation in the public interest in Slovenia and Croatia
Secondary abstract: The purpose of the master's thesis is to describe the differences between Slovenian and Croatian legislation in the case of urban planning which is closely related to expropriation. Our goal is also to identify the most common errors in determining compensation and to highlight the shortcomings of the current real estate valuation system because in Slovenia there is no uniform methodology that would regulate the determination of compensation for expropriation cases. As expropriation is a very sensitive matter, it must be insisted that all parties to the proceedings are satisfied. An analysis of the appraisal valuation report was made and a couple of examples of determining the compensations in practice were given. These showed that in the future the legislation and the valuation system itself will have to change in the event of expropriation. We found that throughout the history of expropriation there have been many errors in the assessment of compensation for expropriated real estate. Therefore, we suggested that based on the experience of experts, the existing laws and methodology for assessing the value of real estate in the event of expropriation be improved.
