Abstract
Namen diplomskega dela je preučiti in predstaviti delovanje državnega preventivnega mehanizma v Republiki Sloveniji, razumeti pravne temelje za delovanje ter ugotoviti kakšna je bila realizacija priporočil, ki jih je državni preventivni mehanizem izdal. Naloge državnega preventivnega mehanizma so bile z Zakonom o ratifikaciji Opcijskega protokola h Konvenciji proti mučenju in drugim krutim, nečloveškim ali poniževalnim kaznim ali ravnanju dodeljene Varuhu človekovih pravic Republike Slovenije. Varuh funkcijo državnega preventivnega mehanizma opravlja predvsem z rednimi obiski krajev odvzema prostosti, zato je bila leta 2015 ustvarjena posebna enota DPM, ki obiskuje le te kraje, drugih individualnih pobud pa ne obravnava. V skladu z Zakonom o varuhu človekovih pravic je dolžnost Varuha, da Državnemu zboru predaja redna ali posebna poročila o svojem delu, poroča o pravni varnosti državljanov ter ugotovitvah o stopnji spoštovanja človekovih pravic. Varuh v vlogi državnega preventivnega mehanizma deluje od pomladi 2008, vsako leto pa pripravi poročilo o svojem delu v vlogi DPM, ki je sestavni del rednega Poročila Varuha človekovih pravic Republike Slovenije, čeprav je tiskano v ločeni publikaciji. V diplomskem delu smo s preučevanjem letnih poročil Varuha o izvajanju nalog in pooblastil državnega preventivnega mehanizma ugotovili, da se iz leta v leto izboljšuje stanje na področju človekovih pravic, bivalnih razmer in ravnanj z osebami, ki jim je odvzeta prostost. S sodelovanjem Varuha z nevladnimi organizacijami se število sodelujočih pri izvajanju nalog državnega preventivnega mehanizma povečuje, kar omogoča kvalitetnejše in pogostejše obiske ustanov. Državni preventivni mehanizem ob svojih obiskih vsako leto opaža nepravilnosti in pomanjkljivosti, zato izdaja ustreznim organom priporočila za njihovo odpravo. Varuh je zadovoljen z odzivi pristojnih organov obiskanih ustanov, saj so pripravljeni sodelovati ter poskušajo sprejeti vse ukrepe za potrebne izboljšave, ki so v njihovi domeni.

The goal of diploma thesis is to study and to present how the national preventive mechanism works in the Republic of Slovenia, to understand the legal foundations and to determine the realization of recommendations from the National preventive mechanism. The tasks of the National preventive mechanism were assigned to the Human Rights Ombudsman on the bases of the Act ratifying the Optional Protocol to the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment. The Human Rights Ombudsman is implementing the function of National prevention mechanism with visits to the places of arrests and that is why there was created special unit of National prevention mechanism in 2015 with its sole purpose of visiting these places. In accordance with the Human Rights Ombudsman Act the duty of the Human Rights Ombudsman is to report to the National Assembly his regular findings or special reports of his work, he must also report about legal security of the citizens and his findings about the level of respect of the human rights in the country. The Human Rights Ombudsman in his role of National prevention mechanism functions since spring of 2008 and every year he presents a yearly report of his work in his role of National prevention mechanism, this part is a component of regular Report of the Human Rights Ombudsman of the Republic of Slovenia, even though it is printed in separate publication. In the diploma thesis we studied the yearly reports of the Human rights Ombudsman on performing tasks and powers of the National prevention mechanism, and we found out that the situation regarding human rights, living conditions and the treatment of persons that were detained is getting better every year. With the cooperation of the Human Rights Ombudsman and non-governmental organizations the number of people getting involved in performing tasks of National preventive mechanism is rising and this enables better and more frequent visits to the detainment locations. The National preventive mechanism notices irregularities and shortcomings with visits every year, that is why it publishes recommendations to the relevant authorities, so they can be eliminated. The Human Rights Ombudsman is satisfied with the reactions of authorities that were visited, because they show that they are prepared to cooperate, and they try to accept all measures in their power to improve the situation. |
