Abstract

Namen magistrske naloge je bil raziskati ustreznost ureditve materinskega in starševskega dopusta v Sloveniji z vidika mater, ki opravljajo delo v nestandardnih oblikah (zaposlitev za določen čas, za krajši delovni čas itd.) in ki v primerjavi s standardno obliko zaposlenosti za nedoločen polni delovni čas nudijo manjšo zaposlitveno varnost. Ob tem, da večina žensk v Sloveniji koristi celoten materinski in starševski dopust in so posledično odsotne s trga dela eno leto, lahko zaradi tega občutijo številne negativne posledice, tako v kariernem kot v finančnem smislu, zato je ustrezna zakonska podpora tej skupini mater nujna. Skozi analizo pravnih virov, obstoječih raziskav in tudi lastne anketne raziskave smo ugotovili, da slovenska družinska politika ne sledi potrebam mater v nestandardnih oblikah dela. Zaradi nefleksibilnega načina izrabe materinskega, očetovskega in starševskega dopusta ter neobstoječega otroškega varstva v času koriščenja teh dopustov matere v prvem letu po rojstvu otroka ne morejo ohranjati stika s trgom dela, kar je za naravo nekaterih poklicev nujno. Stalna vključenost v trg dela je lahko odločilen dejavnik ohranitve izbrane oblike dela. Mednarodna primerjava je pokazala, da države, ki imajo starševsko varstvo urejeno glede na različne potrebe staršev, omogočajo lažje usklajevanje družinskega in poklicnega življenja, kar dviguje kakovost življenja družin. Na podlagi anketne raziskave smo ugotovili, da je moral del mater med koriščenjem materinskega in starševskega dopusta delati, kljub prepovedi dela v času prejemanja nadomestila za starševsko varstvo, in skoraj polovica vprašanih si je želela fleksibilnejše izrabe starševskega dopusta po dnevih.

Secondary title: The relevance of maternity and parental leave arrangement from perspective of non-standard forms of work
Secondary abstract: The text thoroughly researches adequacy of maternity leave and parental leave in Slovenia in relation to mothers working part time jobs, temporary employment etc. These forms are offering less security comparing to the more traditional forms of employment such as indefinite or full time employment. Considering women on most part use the one year maternity or parental leave in full the negative consequences manifest in their careers and financial standing making a statutory support for them a priority. Analysis of legal sources, existing research data, and our own surveys will show how slovenian family policies aren't aligned with the mothers' needs in non-standard employment practices. Inflexible uses of maternity, paternal and parental leave and non-existent childcare during the child's first year the mothers are unable to remain on track with the labor market needs which is in some careers indispensable. Permanent contact with the labour market proves to be crucial in a career choice. A comparison with other systems internationally shows more flexible solutions aligned with various needs of the parents will facilitate family life and raise its quality. Our survey also found that some mothers worked during the parental leave, despite work being banned while receiving the maternity leave compensation. Almost half of the respondents wished for a more flexible parental leave practices.
