Abstract

Magistrsko diplomsko delo obravnava kazenskopravne vidike šikaniranja na delovnem mestu, ki je zajet v 197. členu Kazenskega zakonika, in spada v 22. poglavje Kazenskega zakonika, ki predpisuje kazniva dejanja zoper delovno razmerje in socialno varnost. V uvodnem delu so predstavljena vsa izvršitvena ravnanja, ki sestavljajo kaznivo dejanje šikaniranja na delovnem mestu, ki so vseskozi podprta s sodno prakso, primarno, Vrhovnega sodišča Republike Slovenije. V osrednjem delu se nadaljuje razčlenitev zakonske konstrukcije šikaniranja na delovnem mestu, kar je osrednja tema magistrskega diplomskega dela, in se med drugim dotika tudi vprašanje naklepa, malomarnosti, kolektivnega kaznivega dejanja ter morebitna izvršitev konkretnega kaznivega dejanja v silobranu. Končno poglavje je namenjeno prekrškovnemu in kazenskemu postopku, ki spremljata vsako kaznivo dejanje.

Secondary title: Criminal aspects of Harassment in the Workplace
Secondary abstract: The master's thesis deals with the criminal law aspects of harassment in the workplace, covered by Article 197 of the Criminal Code, and belongs to Chapter 22 of the Criminal Code, which prescribes criminal offenses against employment and social security. The introductory part presents all enforcement actions that constitute the criminal offense of harassment at the workplace, which are supported continuously by the case law, primarily, of the Supreme Court of the Republic of Slovenia. The focal part continues the analysis of the legal structure of harassment in the workplace, which is the central theme of the master's thesis and includes, among other things, intent, negligence, collective crime, and the possible commission of a specific crime in force. Finally, a few more pages are devoted to the misdemeanour and criminal proceedings that accompany every criminal act.
