Abstract

Upravni organi, ki odločajo v upravnih zadevah, se pri svojem delu srečujejo z odločanjem po prostem preudarku oziroma z uporabo nedoločenih pravnih pojmov. Skozi zgodovinski razvoj prostega preudarka so se o njem oblikovala različna mnenja in razlage. Prvi problem, ki ob tem nastane, je različno razumevanje pojma, saj lahko vzbudi vtis, da je organom dovoljena arbitrarnost oz. samovolja pri odločanju. S tem je tesno povezan tudi dvom o njegovi potrebnosti pri odločanju na določenih upravnih področjih in za delovanje pravne države. Za uspešno delovanje javne uprave na področju socialnega varstva, kakor tudi na drugih področjih, je pomembno spoštovanje načela pravne države; slednje med drugim zahteva tudi odločanje v skladu z danimi pooblastili in v mejah namena, za katerega ji je pooblastilo dano. Na nekaterih upravnih področjih imajo organi torej možnost, da odločajo po prostem preudarku. Ključnega pomena pri tem je, da upravni delavci, ki odločajo v konkretnih upravnih zadevah, uporabljajo prosti preudarek (in zapolnijo pomen nedoločenih pravnih pojmov) skladno z načelom zakonitosti, saj je s tem povezano vprašanje pravilne uporabe materialnega prava. V praksi marsikdaj pride tudi do zlorabe in kršitev prostega preudarka, zato so posameznikom zagotovljena pravna sredstev, ki jih uveljavlja v primeru nezakonitega poseganja v pravice obveznosti in pravne koristi.

Secondary title: Discretion and selected undefined legal terms in the field of social welfare
Secondary abstract: Administrative authorities that make decisions in administrative matters deal with discretion or the use of uncertain legal concepts. Through historical development of discretion several opinions and explanations have formed. The first problem that arises is the different understanding of the concept since this can create the impression that the authorities can be arbitrary or discrete in making decisions. Closely related to this is also the doubt about its necessity in making decisions in certain administrative areas and for the functioning of the rule of law. For a successful functioning of public administration in the field of social welfare as well as in other areas the respect for the rule of law is important; among other things the latter also requires the decision-making in accordance with the given authorizations and within the framework of the purpose for which an authorization has been given. In some administrative areas the authorities have the discretionary power. The key issue is that the administrative staff that makes decisions about concrete administrative things uses the discretionary power (and fulfills the meaning of uncertain legal concepts) in conformity with the principles of legality since the question of the correct usage of the substantive law is related to this. In practice abuse and violations of discretion often occur that is why legal remedies are provided to individuals that they can apply if illegal interference in legal rights and obligations occur.
