Abstract

Namen dela je bil opredeliti ter identificirati značilnosti načela zakonitosti in korupcije v javni upravi, analizirati s strani Komisije za preprečevanje korupcije ugotovljena korupcijska ravnanja in ugotoviti značilnosti kršitev načela zakonitosti v javni upravi v Republiki Sloveniji zaradi korupcije. Cilj dela je bil ugotoviti značilnosti korupcijskih kršitev načela zakonitosti v javni upravi preko analize utemeljenih konkretnih kršitev (kdo krši, na katerih področjih, kateri elementi načela zakonitosti so največkrat zlorabljeni/kršeni ipd.) ter kakšne posledice se zaradi kršitve načela zakonitosti kažejo v praksi in kako bi zmanjšali kršitev načela zakonitosti. Rezultati analize kažejo, da je Komisija za preprečevanje korupcije v Republiki Sloveniji identificirala 193 koruptivnih ravnanj, od tega je bilo v javni upravi zaradi korupcije v 172 primerih kršeno načelo zakonitosti. Najpogosteje kršen element načela zakonitosti zaradi korupcije je vezanost subjektov javne uprave na ustavo, zakone in podzakonske akte, pri čemer se kršitve pojavljajo kot kršitve dolžnega ravnanja (javni uslužbenci nekaj storijo, kar je prepovedano). Pri tem se kršitve načela zakonitosti največkrat kažejo kot nasprotje interesov, kršitve pri javnih naročilih in kršitve v postopkih razpolaganja z lastnim premoženjem. Tipični storilec kršitve je javni uslužbenec, zaposlen na ministrstvu. Zaradi kršitve načela zakonitosti najpogosteje prihaja do dveh tipičnih posledic: bodisi premoženjska korist za storilce oziroma povezane osebe bodisi oškodovanje javnega proračuna. Da bi preprečili kršitve načela zakonitosti, je kot najučinkovitejše orodje identificiran načrt integritete.

Secondary abstract: The purpose of the work was a) to define the characteristics of the principle of legality and corruption in public administration, b) to analyze corrupt practices identified by the Commission for the Prevention of Corruption and c) to determine the characteristics of violations of the principle of legality in public administration due to the corruption in the Republic of Slovenia. The aim of the work was to determine the characteristics of corruption violations of the principle of legality in public administration through the analysis of substantiated concrete violations (who violates, in which areas, which elements of the principle of legality are most often abused, etc.). practice and how to reduce breaches of the principle of legality. The results of the analysis show that a total of 193 corrupt practices were identified by the Commission for the Prevention of Corruption in the Republic of Slovenia, of which the principle of legality in public administration was violated in 172 cases due to corruption. The most frequently violated element of the principle of legality due to corruption is the binding of public administration entities to the constitution, laws and by-laws, with violations appearing as breaches of duty (public servants do something that is prohibited). Violations of the principle of legality are most often manifested as conflicts of interest, violations in public procurement and violations in the procedures of disposing of one's own property. A typical perpetrator of a violation is a civil servant employed by the ministry. Violation of the principle of legality most often leads to two typical consequences: a) material gain for the perpetrators or related persons, and b) damage to the public budget. However, in order to prevent breaches of the principle of legality, an integrity plan has been identified as the most effective tool.
