Abstract
Živimo v dobi informacijske tehnologije, kjer so kvalitetni videonadzorni sistemi praktično cenovno dostopni najširši javnosti. Videonadzor je tako postal sestavni del našega življenja, na drugi strani pa je zasebnost ena pomembnejših človekovih pravic, ki je vedno bolj zaščitena, zato je zakonita uporaba videonadzornih sistemov v odvisnosti od človekove zasebnosti, kot temeljne človekove pravice in svoboščine, regulirana z več pravnimi akti.
V diplomskem delu smo obravnavali videonadzorne sisteme in njihovo uporabo v kazenskih postopkih. Proučili smo razvoj videonadzornega sistema, način delovanja, njihovo uporabnost in seveda legitimne možnosti uporabe videonadzora po veljavni zakonodaji R Slovenije, tako na javnih mestih kot v zasebnem prostoru.
Z namenom zagotavljanja sledljivosti in večje uporabnosti zavarovanega video materila, ki v kazenskih postopkih služi kot dokaz, je slovenska Policija, leta 2014, v sklopu projekta Face Trace, na državnem in regionalnem nivoju vzpostavila novo obliko dela, tako imenovano prepoznavno službo, umeščeno v Sektorje kriminalistične policije vseh policijskih uprav. Njena temeljna naloga je prepoznava oseb, izdelava fotorobotov in ovrednotenje zavarovanih posnetkov nadzornih kamer, pregled in analiza posnetkov, preiskava delov posnetkov in primerjava storilcev z nakazanimi osebami. Z raziskavo smo ugotovili, da se uporabnost zavarovanih posnetkov, kot dokaz v kazenskih postopkih, strmo vzpenja in da se njihovo dosledno ovrednotenje v obliki različnih policijskih aktov uspešno in nepogrešljivo uporablja v kazenskih postopkih na vseh nivojih.

We live in the age of information technology, where quality video surveillance systems are practically affordable to the general public. Video surveillance has become an integral part of our lives, but on the other side, privacy is one of the most important human rights, which is increasingly protected, so the legal use of video surveillance systems depends on human privacy, as fundamental human rights and freedoms, regulated by several legal acts.
In the thesis we discussed video surveillance systems and their use in criminal proceedings. We studied the development of the video surveillance system, the modus operandi, their applicability and of course, the legitimate possibilities of using video surveillance under the current legislation of the Republic of Slovenia, both in public places and in private spaces.
In order to ensure the traceability and greater usability of secured video material, which serves as evidence in criminal proceedings, the Slovenian Police, in 2014, as part of the Face Trace project, established a new form of work at the national and regional level, the so-called recognizable service. It is located in the Criminal Police Sectors of all police administrations. Its basic task is the identification of persons, photo-robots production, and the evaluation of secured surveillance camera footage, the review and analyze the footage, the investigate parts of the footage and compare the perpetrators with the indicated persons. The research found that the usefulness of secured recordings, as evidence in criminal proceedings, is rising sharply and that their consistent evaluation in the form of various police acts is successfully and indispensably used in criminal proceedings at all levels. |
