Abstract

V preteklih letih so se države Zahodnega Balkana, vključno s Slovenijo, znašle na tako imenovani zahodnobalkanski migracijski poti, pod pritiskom katere so bile tako ali drugače primorane sprejeti nove zakone in pravila na področju azilne politike. Vsaka od držav na tej večfazni poti je imela svojo vlogo, hkrati pa je prihajalo tudi do večjih sprememb zaradi sprememb "sosednjedržavne" zakonodaje in implementacij ter poenotenja z evropskim pravom. V 2015, se tako na primer, glavna pot migrantov prek Madžarske zaradi nove strožje zakonodaje preusmeri čez Hrvaško in Slovenijo, s čimer postaneta še ti državi ključni del poti. Sprememba zakonodaje, vsaj v Sloveniji, je bila potrebna zaradi močnejše vzpostavitve azilnega sistema, da bi ta zmogel prenesti večje število primerov prosilcev kot kadarkoli poprej. Poplava migracij je prav tako s seboj prinesla možnosti za dobičkonosne posle, tihotapstva, razvoj kriminalnih mrež in rast kriminalnih združb, katerim so se s spremembami legislative države morale postaviti po robu. Med migracijami so se ne le javnosti, temveč tudi stroki brisale meje med pojmi azilant, migrant, begunec, zato v delu predstavimo definicije in okvirje pojmov, podrobneje primerjamo statuse oseb v postopku in vse druge podobnosti in razlike, ki izhajajo neposredno iz zakonov držav Zahodnega Balkana. V procesu migracij je imela skoraj vsaka država svoj izziv in svojo vlogo, zato so v nalogi predstavljene primerjave zakonodaje, ki so tudi zaradi vseh ozadij zelo pomembne za razumevanje širše slike in kot take pomembne za zahodnobalkanske migracijske poti. V nalogi poskušamo predstaviti bistva ureditve pri vsaki izmed držav, pogled skozi oči prakse, pozitivne spremembe in ovire, na katere je potrebno opozoriti. V delu so podani pogoji in zakonski okviri migranta, s katerimi se le-ta sreča ob prihodu v eno izmed držav Zahodnega Balkana, nato pa poskušamo predstaviti problematiko ilegalnih migracij, življenjskih situacij ljudi v postopku migracije in morebitnih kršitev, do katerih prihaja.

Secondary abstract: Over the years western Balkan countries including Slovenia found themselves in the midst of the western Balkan migration route, under the influence of which they had to implement new laws and rules regarding asylum politics. Each of these countries were part of a polyphasal route where they played specific roles, while bigger changes were happening because of the changes of laws in the neighboring countries, implementation and standardizing in accordance with European laws. The migrations also brought new business opportunities, smuggling, the development, and growth of criminal rings which the countries had to stand against by implementing new legislation. During this period, the lines between refugee, migrant and immigrant were blurred, that is why in dissertation are explained these terms, compare the status of these people when in proceedings, and researched all the similarities and differences regarding West Balkan law. In the migration process every country faced their challenges and had their roles. In dissertation are presented legislations, because that is the key to understanding bigger issues and the importance of the west Balkan migration route. Dissertation is based on presenting the main points of the specific state regulations through the eyes of practice, positive changes, and obstacles that we need to pay more attention to. In dissertation are presented the conditions and legislative frame that migrants face with when coming to one of the west Balkan countries, furthermore I am presenting the problem of illegal migrations, the life situations of migrants in proceedings face and the possible violations that may occur.
