Abstract
Diplomsko delo obravnava družinsko pravo ter temeljne pravice otrok, ki se kažejo pri razvezi zakonske zveze. Pomemben mejnik v razvoju pravic otrok je pomenilo sprejetje Konvencije o otrokovih pravicah ter Evropske konvencije o uresničevanju otrokovih pravic, ki sta otroka postavili kot subjekt pravic in dolžnosti, ter mu dali pravico do mnenja in svobodnega izražanja. Najpomembnejše načelo družinskega in otroškega prava je načelo otrokove koristi, ki je vodilo in cilj v vseh postopkih, ko gre za otroke ter njihove pravice in dolžnosti. Družinski zakonik, kot temeljni vir slovenskega družinskega prava, postavlja vse pristojnosti pri odločanju ob razvezi zakonske zveze na sodišča, medtem ko ima CSD posvetovalno in predlagalno funkcijo. Bistveno vlogo za uresničevanje otrokovih pravic pri razvezi zakonske zveze ima prav tako postopek predhodnega svetovanja in mediacija, s katero se pomaga staršem spoprijeti s spori in preusmeriti njuno pozornost na iskanje sporazuma v dobrobit skupnih otrok. Staršem je vedno omogočeno, da se ob zakonskih sporih sama sporazumeta o varstvu in vzgoji otrok, preživljanju, stikih in ostalih vprašanjih, ki se morajo rešiti ob razvezi zakonske zveze, pri čemer sodišče preverja, da so ob sporazumih primarno varovane koristi otrok. V kolikor starša kljub pomoči CSD ter meditorjev še vedno ne najdeta skupnega jezika, bo odločilo sodišče, kjer pa končno odločitev spremlja še ena pomembna otrokova pravica in sicer pravica do mnenja in svobodnega izražanja. Otrokovo mnenje se v postopkih razveze zakonske zveze mora upoštevati, v kolikor je otrok sposoben razumeti njegov pomen in posledice. Otroci so v institutu družine ranljiva skupina, zato mora država vedno poskrbeti, da bo na najboljši način zavarovala koristi otrok in bodo ob razvezi zakonske zveze nastale čim manjše posledice na njihovem telesnem in duševnem razvoju.

This Diploma thesis is discussing family law and fundamental children's rights that are important in the process of dissolution of marriage. The milestone in the process of development of children's rights was adoption of Convention on the Rights of the Child and European convention on the Exercise of Children's rights. Both of them appointed a child as a subject of rights and duties and gave a child the right for opinion and freedom of expression. The most important principle of family law is the principle of the best interest of the child. According to the Family code, the central institution that is protecting child's benefits is the court, while Social care centres have legal proposal and consultative function. Essential role in fulfilment of children's rights in the process of dissolution of marriage have also procedures of beforehand consultation and mediation, which helps parents to confront their disputes and redirect their attention towards finding an agreement for the welfare of their children. Parents have always an option to find a solution on their own regarding care, education and maintenance of their children, as well as child-parent contact, the division of common property and the rest of essential issues that needs to be solved in the process of divorce. Simultaneously, the court pays attention that the best interest of the child is being protected. In case that parents cannot find common grounds even with the help of Social care centre and mediator, it will be decided on by the judge. In its final decision the court will take into consideration a child's opinion, provided that the child is able to understand the meaning of the situation and its consequences. While children are vulnerable social group, the country must always ensure that children's best interests are protected and that the impact of dissolution of marriage will have as little consequences as possible on their mental and physical development. |
