Abstract

Po več kot 40 letih je Slovenija 21. marca 2017 s sprejetjem Družinskega zakonika doživela reformo družinskega prava. V diplomskem delu so predstavljene novosti, ki jih je na področju sklenitve zakonske zveze uvedel Družinski zakonik. Postopek sklenitve zakonske zveze je v diplomskem delu primerjan s prejšnjo ureditvijo, ki je veljala po Zakonu o zakonski zvezi in družinskih razmerjih. V celotnem diplomskem delu je uporabljena opisna metoda. Primerjava s prejšnjo ureditvijo in ureditvijo v nekaterih drugih državah je opravljena na podlagi primerjalne metode, oris razvoja instituta zakonske zveze pa je predstavljen s pomočjo zgodovinske metode. Z Družinskim zakonikom je sicer ohranjena tradicionalna definicija zakonske zveze, po kateri je zakonska zveza življenjska skupnost moža in žene. S tem veljavna zakonodaja istospolnim partnerjem še vedno ne dopušča sklenitve zakonske zveze. Po drugi plati pa je Družinski zakonik naredil korak naprej s tem, da je bodočima zakoncema omogočil večjo avtonomijo pri sami sklenitvi zakonske zveze. Bodoča zakonca se lahko na podlagi ustavne pravice do samoodločbe sama odločita, kakšno stopnjo svečanosti postopka želita, prav tako pa tudi, kje in pred kom bi želela zakonsko zvezo skleniti. Pri tem je treba poudariti, da po načelu ločitve države in verskih skupnosti sklenitev zakonske zveze ostaja v pristojnosti države. Pravne posledice zakonske zveze država torej priznava le v primeru sklenitve zakonske zveze pred pristojnim državnim organom. Pri pisanju tega diplomskega dela so bili vodilo veljavna zakonodaja in komentarji Družinskega zakonika, povzeta pa je tudi relevantna strokovna literatura slovenskih in tujih avtorjev.

Secondary abstract: After more than 40 years, Slovenia experienced a reform of family law with the adoption of Family Code on March 21, 2017. This diploma thesis presents the innovations introduced by the Family Code in the field of marriage. Throughout this work conclusion of marriage is compared to the past legislation, which was valid according to the Marriage and Family Relations Act. A descriptive method is used throughout the thesis. The comparison with the previous regulation and the regulation in some other countries is made on the basis of the comparative method, and development of the institute of marriage throughout the history is presented with the help of historical method. The Family Code perceives the traditional definition of marriage, according to which marriage is defined as a living community of a man and a woman. Therefore, same-sex marriage is still not allowed. On the other hand, the Family Code took a step forward by allowing future spouses greater autonomy in conclusion of marriage. On the basis of the constitutional right to self-determination, the future spouses can decide for themselves what level of the ceremony of the procedure they want, as well as where and in front of whom they want to enter into marriage. It must be pointed out that according to the principle of separation of church and state, marriage remains in authority of the state. Therefore, legal consequences of a marriage are recognized by the state only if the marriage is concluded in front of a competent national authority. Current legislation as well as legal commentaries on the Family act were used as a guide in writing this thesis. This work also contains summaries of the relevant academic literature of Slovenian and foreign authors.
