Abstract
Neplodnost je v sodobni družbi še kako prisotna, saj na plodnost posameznika, poleg morebitnih obolenj, vpliva tudi sam življenjski slog, ki je danes zaradi hitrega ritma življenja pogosto nezdrav. Oploditev z biomedicinsko pomočjo označuje vrsto različnih biomedicinskih postopkov, ki se jih izvede z namenom zanositve ženske brez spolnega odnosa. Pogoji za upravičenost do postopkov OBMP v Sloveniji še vedno izključujejo samske ženske in istospolne, ki bi si želeli na tak način postati starši, prav tako je pri nas zaradi predpisanih pogojev za OBMP iz prakse izključen institut nadomestnega materinstva, ki je sicer primerna rešitev za moške istospolne partnerje in ženske, ki same ne morejo donositi otroka. Namen raziskave je prikazati urejenost postopkov OBMP v Sloveniji predvsem z vidika predpisanih pogojev, navesti vzroke za takšno ureditev in vpliv na možnosti samskih žensk in istospolnih parov ter na razvoj reproduktivnega turizma nasploh. Za namene raziskave je bila uporabljena zgodovinska, deskriptivna, primerjalna, sociološka in sintetična metoda dela. Ugotovljeno je bilo, da Slovenija spada med države s pretežno majhnim krogom upravičencev do postopkov OBMP. Razlogi za to so različni, nekateri imajo podlago v miselnosti družbe, drugi v koristi otroka, spet tretji v prepričanjih medicinske stroke. Dejstvo je, da so različne oblike družine, ne glede na njihov nastanek, vse pogostejše. Pravo se mora takšni družbeni realnosti prilagoditi na vseh področjih.

Secondary abstract: |
Infertility in modern society is quite common, as individual's fertility is affected by not only diseases, but also by the lifestyle, which is often unhealthy, due to the fast rhythm of life. Fertilization with the help of biomedicine denotes a series of different procedures, which are conducted with the purpose of impregnating a woman without sexual intercourse. Conditions for fertilization procedures with the help of biomedicine in Slovenia, still exclude single women and same sex partners, and institute of surrogacy is excluded from practice, which is an otherwise appropriate solution for male same sex partners and women who cannot bear a child. The purpose of this research is to show the orderliness of OBMP procedures in Slovenia, especially in terms of prescribed conditions as well as to how they impact the possibilities of single and same sex partners, and the development of reproductive tourism in general. A historical, descriptive, comparative, sociological and synthetic method was used for the purpose of this research. It was found that Slovenia is a country with a predominantly small circle of beneficiaries of OBMP procedures. This is a result based on mentality of our society, interest of a child and the beliefs of the medical profession. However, different forms of the family, regardless of their origin, are becoming more common in our society, and the law must adapt to such social reality in all areas. |
