Abstract

Preiskovanje kaznivih dejanj zoper spolno nedotakljivost je zapleteno, saj zahteva visoko specializirane preiskovalce, ki z dobrim načrtovanjem in organizacijo dela ter povezovanjem s forenzičnimi strokovnjaki v laboratoriju delujejo na področju iskanja, zavarovanja in shranjevanja bioloških sledi, z namenom dokazovanja v kazenskem postopku. Le tesno medsebojno sodelovanje in odlično poznavanje področja preiskovanja omogoča uspešno preiskovanje primerov kaznivih dejanj zoper spolno nedotakljivost. V diplomski nalogi najprej predstavimo in opišemo ključna kazniva dejanja zoper spolno nedotakljivost, ki jih slovenska zakonodaja obravnava v Kazenskem zakoniku. Predstavimo število in delež uspešno preiskanih kaznivih dejanj zoper spolno nedotakljivost v Republiki Sloveniji med letoma 2015 in 2019. V osrednjem delu zaključnega dela se osredotočamo na vrste bioloških sledi, s katerimi se preiskovalci pri preiskovanju kaznivih dejanj zoper spolno nedotakljivost najpogosteje srečujejo. Podrobno opisujemo vsako vrsto in opisujemo načine njihovega pravilnega zavarovanja in shranjevanja. Ker so biološke sledi izredno občutljive, opozorimo na problematiko kontaminacije in predstavimo pravilno ravnanje kriminalističnih tehnikov pri preiskovanju. Predstavimo tudi potek preiskovanja kaznivih dejanj zoper spolno nedotakljivost, v katerega so vključeni različni subjekti, ki med seboj za uspešen zaključek preiskave tesno sodelujejo. Opišemo potek preiskovanja, ki se začne s samo zaznavo kaznivega dejanja, razgovor z žrtvijo, zbiranju informacij, opravljanju ogleda kraja kaznivega dejanja in klinični pregled žrtve ter osumljenca. V nadaljevanju se poglobimo v forenzične preiskave in njihov pomen pri preiskovanju kaznivih dejanj zoper spolno nedotakljivost. Preiskave raznovrstne biološke sledi izvajajo usposobljeni strokovnjaki oddelka za biološke preiskave Nacionalnega forenzičnega laboratorija. Analizirali smo forenzično in kriminalistično-tehnično dejavnost ter ugotavljali najpogostejše predmete izvajanih preiskav v obdobju med leti 2015 in 2019.

Secondary abstract: Investigating crimes against sexual integrity is complex, as it requires highly specialized investigators who, with good planning and organization of work and association with forensic experts in the laboratory, work in the field of searching, insuring and storing biological evidence. Only close cooperation and excellent knowledge of the field of investigation enables the successful investigation of cases of sexual integrity. In the dissertation, we first present and describe the key crimes against sexual integrity that Slovenian legislation consider in the Criminal Code. We present the number and proportion of successfully investigated crimes against sexual integrity of the Republic of Slovenia between the years of 2015 and 2019. In the main part of the dissertation, we focus on the types of biological traces, that forensic science technicians most often encounter when investigating crimes against sexual integrity. We describe each one of them in detail and describe the ways of their proper insurance, and storage. As biological traces are extremely sensitive, we draw attention to the problem of contamination and present the correct conduct of investigators in the investigation. We also present the structure of the investigation of crimes against sexual integrity, which includes different entities that work closely together to successfully complete the investigation. We describe the course of the investigation, which begins with the detection of the crime itself, the interview with the victim, the collection of information, the investigation of a crime scene and the clinical examination of the victim and the suspect. Hereinafter, we deepen into a forensic investigation and their importance in investigating crimes against sexual integrity. Investigations of different biological traces are implemented by qualified investigation experts of the National Forensic Laboratory. We have analyzed the forensic and forensic-technical activity, and have identified the most common investigations they carried out in the period between the years of 2015 and 2019.
